took a trip to NYC and walked by a Mister Softee truck parked by the NY Public Library on the corner of 5th and 40th I think.  Guy was inside the truck making a soft serve and smoking a cigarette while arguing with a cop who was telling him to move his damn truck.
I miss Mister Softee

I don't think Dairy Queen has room to comment.  They haven't been a factor in the soft-serve
business for years, except in Texas.  (Texans, for some reason, are obsessed with DQ.  But then,
Texans are also obsessed with Ted Cruz.)

The guy was a former franchisee who spent years investing in the brand, then for some reason his franchise was terminated or not renewed.  He may have had a grudge against Softee for that. It left him with a bunch of ice-cream trucks and an obligation to de-identify them -- paint over the Softee logo, etc.  Did he do what he thought was the minimum necessary to deidentify, and just miss by a mile?  Or did he go over the top on purpose?

If the first and he had legal advice on the re-branding he may have a malpractice claim, at least ...
