To clarify, the right to free speech, censorship, etc. in common use can refer to either constitutional rights under the first amendment or to a more general notion of free speech. As far as the constitution is concerned I can shoot the comedian for not being funny, but under the more general notion of free speech that would be considered rude.

Also, Fark admins should pick one random day per week to filter xkcd links just because they can.  Replace them with a randomly chosen Family Circus.

Yeah, but that misses that actual point. People love to nail themselves to the cross...to feel tragic, embattled, even martyred. The fact that their constitutional right to free speech isn't  actually being violated is merely incidental.

If I tell you you're an asshole in your living room, you will likely kick me out of your house. There really isn't a general notion of free speech because property rights trump speech rights. And Fark's servers are someone's property. End of story.

Yes...because that is in no way a mainstream theory, that has been generally accepted since the 90s, and is in no way considered crackpot...?

You've got a better grasp on it than Randall, who sometimes loses perspective of the common idiot because of his high level of intellectuality. You can't count on the Fox News and WND idiots to read this comic and understand that they're idiots. Ignorance is bliss.

Yes, yes we will.

But IMHO, whether or not it's a First Amendment issue is usually not the interesting part. The interesting part is dissecting and analyzing the motives and goals of the parties involved.

Those Family Circus cartoons upthread always make me laugh for some reason. Probably because my kid has walked into the bedroom and yelled MOM IS SLEEPING DAD and my wife has mumbled something along those lines

I'd love to see that argument put to a scientific measurement. I'll yield to your argument when you rank the number of times "1st Amendment" or "First Amendment" (not case sensitive) mentioned on each site. I'd wager that FoxNews and WND both have more mentions than either MSNBC or Daily Kos. Anyone want action on that?

You know you did your job correctly when your kids bring up the same argument in school, confuse their fellow students, and get extra credit points from the teacher for actually grasping the nuances of Free Speech.

And as somewhat of a Conservative, I've had to remind the fringers of my world that you can say what you want and be immune from government persecution, yet it's likely you could feel the repercussions of private-sector outrage.  It's the way the world works, as it should. Open discourse for everyone, but man-up if you piss people off enough to make them want to rage on you.

Yeah, funny how some people feel the need to pay money to hang out on a web site they don't like and tell everyone how much they dislike it.

But at least nobody is stepping on his First Amendment rights.

site:foxnews.com "first amendment" *OR "1st amendment" About 22,400 results
site:wnd.com "first amendment" *OR "1st amendment" About 388,000 results
site:msnbc.com "first amendment" *OR "1st amendment" About 6,260 results
site:dailykos.com "first amendment" *OR "1st amendment" About 281,000 results

of course, that's not strictly applicable to partisans on one side or the other falsely claiming imaginary protections; the first page of dailykos results has the result "Climate Science Deniers Wrap Themselves in First Amendment" - pointing to the other side, not claiming to be victims.

The only available comparison is by Google page count, not actual instances. Unfortunate that I can't just get an index count out of them - and without that, I won't take the action, The My Little Pony Killer.

Great timing on your comment there. Makes me look like a bit of a dick, doesn't it?

Though there are other things to assume here. How many other ways are there to say First Amendment? Also, we're counting on writers/commenters to spell correctly.
