Obama's refusal to prosecute anyone who waterboarded on behalf of the government guarantees that a future president will fail to agree with this part of the UN Convention Against Torture, which is a signed and ratified treaty by the United States and therefore federal law:

"No exceptional circumstances whatsoever, whether a state of war or a threat or war, internal political instability or any other public emergency, may be invoked as a justification of torture."

The
language is as plain as can be. No justification for torture exists in any possible situation. If you thought the entire planet was about to be destroyed and torturing someone might save it, it's still illegal. There are literally no exceptions. Sure, someone might decide they have to break the law. But then at least acknowledge that you broke the law and accept prosecution and sentencing and quote A Tale of Two Cities when you realize it was a far, far better thing you did to sacrifice yourself to save others. The idea that government agents need assurance that they can break the law with impunity or else they won't defend the country is the worst kind of depravity.
