God-DAMN! Stay away from crazy lady.  It's not just the creativity, it's that she kept it up. Anyone else would have been like "fark it, not working" and then broken a window or something and felt better.  Maybe a flaming bag of shiat on the porch.

Yes, but the person on the receiving end of the sex isn't the one giving the consent. Rowe was soliciting people to have forcible sex with a person by knowingly falsely representing that the victim had consented to it.

Cal Penal Code s. 261 defines rape as "an act of sexual intercourse accomplished with a person not the spouse of the perpetrator, . . . (2) Where it is accomplished against a person's will by means of force, violence, duress, menace, or fear of immediate and unlawful bodily injury on the person or another."

Did Rowe solicit this act? Assuming the jury finds that, by posting the ad, she knew or should have know that it would result in:

1. an act of sexual intercourse against the victim
2. with a person not the victim's spouse
3. to be accomplished against the victim's will
4. by means of force.

The perpetrator might not have the necessary mens rea for #3, as he might have been reasonable in his belief that the ad was legit and the victim was consenting to forcible sex. But Rowe certainly knew that the victim had not given consent to forcible sex, so Rowe had all the necessary mens rea for element #3 (and all the other ones, too), even if no one could be charged with actual rape.

All I can do is just shake my head...what is wrong with someone where they would think this was ever an OK thing to do?  And the fact that she stopped because one of the men sent her a nude photo and she got disturbed?  That's when she decided to stop...because she got disturbed over that.  Not that she got disturbed by putting another person's live in danger not to mention all of the other things she had done but that she got disturbed because she got a cock shot via e-mail over a posting like this.

1) Because rape is a crime defined by law, and that law often had a marital exception written into it.
2) Yes, in those jurisdictions.
3) Depends...probably.  In fact, non-marital rape cases are often prosecuted as assaults, etc, because the consent issue never comes up.

It's almost like some of those feminists actually had a couple of worthwhile points...

I pity this woman's daughter. According to TFA, she's in her teens and has the mental capacity of a four or five-year-old; clearly she's more mature than her mother. The thing that makes this terrifying is that she hung onto this grudge for a year at least and was working her way steadily up the ladder of crazy. Sounds to me like she had decided that all her problems would be magically solved if she just got this one house and therefore the couple weren't just people who outbid her, they were evil creeps who were deliberately denying her husband and daughter a good place to live and therefore deserving of any pain she could inflict on them.

You can't be convicted of rape. In Va., there iswas a similar statute (repealed in 2005). "Marital sexual assault" was the appropriate term, and a lesser offense.
