A Los Angeles trial judge threw out that lawsuit, siding with the hospital's attorneys that the second suit was filed too late, beyond the one-year statute of limitations after the family discovered Arroyo's injuries.

I'm so proud of our legal system right now.

You would think the timer would've been reset once the new evidence provided by the pathologist had come to light given it had gone from negligence of bodily remains to negligent homicide.

It's the red lever labeled "EJECT".   They all have it.   Can't suggest pulling on it, especially if you don't have a convertable yet.

I don't. I'm pretty sure that's exactly what she thought. What a nightmare.

But it looks like tort reform is going to prevent another frivolous lawsuit here. So we can thank Jesus for that.

This kind of thing actually used to be a pretty significant problem. They'd actually bury people alive from time to time. Hence the Poe story "The Premature Burial."

There's no statute of limitations on criminal homicide as far as I know. However, there is apparently a statute on civil suits for wrongful death. Huh.

But why? The family didn't suffer any economic damages, so really, they shouldn't be allowed to sue at all. Really, the hospital did the family a favor, because they're not going to have to fork over a fortune for her elder care anymore.

/this is parody of the typical tort reformer. do not mistake these for my real views
//also, i'm pretty sure California caps non-economic damages at $250,000 in med mal cases. So even if this family gets this frivolous lawsuit before a jury, the hospital really doesn't have to worry that much because of the non-existent economic damages.
///tort reformers are assholes. that statement is not parody.

If there is in fact a relevant SOL, the judge ruled correctly. It's the attorney's farkup for nut filing in time.

Unless the freely didn't bring it to the attorney until after the SOL had run, in which case it was a hail Mary and what the fark were they waiting for?
