Massachusetts created a new level of statutory rape when the age difference is at least ten years. The purpose of the law is not to put those men in prison for the ten year mandatory minimum. The purpose of the law is to force more plea bargains. Go to trial, play he-said-she-said, and have a 50-50 chance of ten years. Plead guilty to the lesser charge of ordinary statutory rape, and get a deal for 3 years.

Technically the law does apply to women. The last widely publicized female teacher on male student case was before the law went into effect. The judge basically said women aren't predators and went easy on her until she violated probation by violating him again.

There is a sliding scale. Some one who is "extremely hot" in a Fark headline would get 10 years.  A MILF would get three years, while sharp knees would get two weeks without pay.  As always any teacher qualify for a legitimate FooWIEs green would get a new Buick and reserved parking.

The new penalties seem a little to severe for the crimes. It's just sex...and the kids are 'learning'.....technically.

Sch new laws - as all ratcheting "togh on crime" laws - will help nothing.  These things do not occr becase the perpetrators are not adeqately scared of pnishment.  They know what can happen, and choose to do so anyhow.  So we shold look at why that is.

It is a simple qirk/flaw in hman decision making that most people place VERY little mental weight on the conseqence of the worst case scenario, and almost all mental weight on their (often qite mistaken) perception of the chances that things will go soth.  Their desires weight heavily as well, and they tell themselves "well no one is actally going to find ot" so the worst case scenario doesn't matter at that point.  Yes stdies on risk taking have been done to this regard.

I'm not saying I have a srefire soltion... assming there even IS a good soltion to this, bt doing something for the sake of "we have to do SOMETHING" is jst s jerking orselves off.  It does no good.  I generally feel that doing nothing actally is preferable to doing something that is ineffective.  At least doing nothing does not risk additional harm.  This line of thoght is not niqely held towards the sbject at hand.

I'd have no problem with this if it included ALL state employees, not just teachers.
