There's two.

2014-03-30 12:27:54 PM
I thought shooting was the actual point of having sex....

2014-03-30 12:27:56 PM
As much as I love to call every police shooting unjustified, this guy was justified.  He was a regular civilian who had a mad man come at him with a bottle.  As he was a regular civilian at that moment, I wouldn't expect the deputy to put himself in more danger than I would be willing to place myself.  If the attacker hits you in the head with that bottle, then your lights are out and he's slashing your throat.  Stand your ground means you don't have to take any unnecessary risks to protect your own life.

2014-03-30 12:29:07 PM
If this place is a retirement community, I'll have to side with the officer.

Yuck.

2014-03-30 12:29:27 PM
Fortunately the other guy wasn't packing anything to be concerned with.

2014-03-30 12:32:18 PM
That headline isn't misleading at all.

Story doesn't sense either. Most people don't start a fight with someone that has a gun. If it was concealed, the officer doesn't use it as a deterrent? Just point and shoot?

2014-03-30 12:32:23 PM
Legions of elderly voters, who have no other believed/perceived way to defend themselves against fit young brown thugs, elect representatives to enact laws permitting them to shoot any cocksucker that won't get off their lawn.

Bingo. I think law enforcement is shooting entirely too many people, the deputy in this case sounds like he didn't have much choice. But don't they teach the Vulcan nerve pinch anymore???

Cop told the farking couple to leave the pool.  The farking guy came back later to yell at the cop.  Fight started.  cop pulled gun and boom.

2014-03-30 12:34:59 PM
So the guy said he was a cop, you left, then came back looking for a fight and started one?

Sorry... You bought and paid for this one. I'm siding with the cop on this one.

Sorry, I missed the part where it said half of the couple was a hired prostitute.  Could you point that out in the article, or provide a link to the article that does mention that fact?

2014-03-30 12:37:24 PM
Let's see, guy identifies himself as a cop and tells you to get out of the pool and leave, because other people might find the pool a little yucky.  Most people would grab their stuff and leave and not come back, to get into a beef with the cop, because he might just have a weapon, as most cops do.  Not this guy.  Darwin himself, probably held the gate open so Brainiac could go back and get his ass shot.

/I know he's not dead, but, I have a hypothesis that stupid people die young.

It's not like there haven't been 25 justifiable homicides of people defending themselves and their homes this year alone so far in the city of Detroit.  Oh and the police hate it too.  That why the Detroit Police chief is saying "This should be a message to those who continue to perpetuate violence on Detroiters that enough is enough. You've got to be concerned about good Detroiters who aren't going to stand for it, Detroiters are fed up and they are taking action "

Yeah.  Castle Doctrine and Stand Your Ground are HORRIBLE laws that only allow scare white folk to go minority hunting....

No wait...it's the opposite of that

Satanic_Hamster: Cop told the farking couple to leave the pool.

That's the problem.  WTF difference did it make to anybody that this couple were having it off in the pool?  It doesn't state whether one of the couple were residents with right of access to the pool, but in any case it's probably Against The Rules, which is what bugged Barney there.

Farking hall-monitor-like attitudes detected.

Exactly.  A proper shooting in my book.

The headline is misleading.  The cop didn't shoot over sex, the cop shot because the guy came after him later.

And at close range like that trying to use your gun as a deterrent is asking for it to be taken away from you.

And that's not what the statute reads.  You have to have a reasonable fear of being in danger of losing life or limb. Note the word reasonable.

Some guy hovering over you goes to hit you is a reasonable fear of injury.  As presented in the article, I don't really see the problem.

I did RTFA, and the Deputy is still a trigger-happy pig IMO. A gun should only be used if there is a clear and imminent danger of death to the officer. Not as a "RESPECT MAH AUTHORITAH!" tool.

2014-03-30 12:51:51 PM
where did the article say he tried to hit him with a bottle?

all it said was he was hovering over him which led to a confrontation in which he allegedly took a swing at him.

If the cop had chosen not to 'see the problem', nobody would have gotten shot.  Just walk away and give them their moment, their little frisson of public sex...(it's a peck of fun!)...and make sure the gates are closed so kids can't get in and drown themselves.  Maybe rattle the gates just to give the couple a little extra jolt of excitement.

Cockblocking should be at least a misdemeanor...unless they were fat and ugly, in which case, he should have shot them both like hippos in the Nile.

From your article:

"And of course, having an arrest record doesn't mean you give up your right to defend yourself in the future. A person who was guilty of something in the past may be utterly innocent in a different case now.
In some cases examined by the  Times, a defendant's prior arrests occurred years before their fatal confrontation and therefore may reveal nothing about their propensity for trouble. For example, Max Wesley Horn Jr. successfully claimed self-defense after he shot a man during a 2010 dispute in New Port Richey. The arrests on Horn's record - for battery, larceny and for violating probation - were more than 15 years old"

So you have a perfect right to defend yourself even if you have a criminal history, but OMG!11!  criminals are shooting people under stand your ground!!11!

Absolutely no biased slant there....

If it had been the other way around... If the off duty deputy was confronting a guy who caught him having sex in the pool and asked them to leave and the guy shot the off duty deputy, would it be murder? Would the shooting be justified?

I personally don't think so, but then again I think the deputy shooting the guy was unjustified and excessive. I think cops being able to get away with shooting people whenever they feel even remotely threatened or disrespected is a more than a bit out of control.

Not everyone is strong enough to take a punch like you tough guy.  Also the article said he's in critical condition so it's not murder yet anyway.  There are very few facts and we haven't even heard the pool guy or pool girl's side of the story.  There's a lot of room here for facts before we come to any conclusions.

Strange, but I didn't see that weapon mentioned in the article.  Also, a guy brings fists to a gunfight?  I call shenanigans.  The cop MUST be held to a higher standard than a civilian hiding behind "Stand Your Ground".  Supposedly, the cop has been trained to deal with, and defuse, confrontations, not escalate them into someone in critical condition.

Why didn't the cop simply leave?  Wave his gun and say, "Okay, I'm leaving, but I'm going to call and have some uniformed cops have a word with you about public etiquette."

Instead, Officer Bangy McToughguy shoots the dude.  That's farked up.

Yeah man, why can't we just scrap it out with bare fists? It's not like getting curb stomped ever killed anyone. Why can't I live in a society where I can punch and kick people without fatal repercussions?

the article seems to take the shooter's word for everything. do we know for a fact they were having sex? do we know for a fact the man took a swing at him? what about the girl who was with the guy? what did she say about it?
