OregonVet: duffblue: Since the law is to yield to faster traffic in most states, you have to be a special kind of stupid to do what the driver behind the camera does.

They aren't on the freeway, they're in town in a reduced speed zone  (50)... IANAL, but I don't think that law applies there.

It applies to all roads with more than one lane in both directions, and there are turning lanes on this road

adragontattoo: OregonVet: NicktheSmoker: Also, shouldn't she also get a ticket for using her damn phone while driving?

I picked out three tickets: speeding (not enough to bother with a stop tho), distracted driving (phone), and all that shiat in the windshield.

Failure to pay full time and attention since she is more concerned with videoing the guy driving behind/beside her and then being sure to record him crashed.

I wonder if Fl. can issue her a ticket NOW for distracted driving since it is BLATANT that she is using a cell to record video while moving.  There is NO ambiguity about whether or not she was recording.  If recording of a police officer can be used as evidence, shouldn't this count against her?

You wouldn't have a tender conscience, would you?

OregonVet: sammyk: I don't either.Good, because another story on the news this morning showed the part where she pointed the camera at her dash proving it.

But please don't pretend that there is not an abundance of self important douche bags that think it's their civic duty to block traffic and set the speed for everyone else.

Sure there is. But this isn't relevant here.

Yes it is. She was impeding traffic in the left lane causing a potentially dangerous situation. She made it worse being a dumbass with her cell phone. it could be argued that she created a dangerous situation that contributed to the dumbass in the truck getting into an accident. So there's plenty of dumbass to go around in this case.

How someone wipes out that badly all by himself is beyond me. I bet that doesn't even happen in China.

Thingster: Enormous-Schwanstucker: I'm on the fence with this one so I took out the AW tendencies of her, her propensity to endanger others with her vertical video stupidity while driving and the fact she was pretty much hogging the lane and I am left with this: Unless we're missing something he is in the wrong. Feelings don't matter, the 'coulda/shoulda/woulda' actions mean nothing. If the law specifies she did nothing wrong that's that.

As much as I hate left lane hogs Bubba McRedneck passed her on the right, forgot about the physics of a vehicle with an automatic transmission, a vehicle with excellent engine braking and discovered what happens .When you suddenly decelerate from a moderate speed in a lower gear on a slick road. Couple that with the empty bed and he looped it, very well I might add.

Now it would have been funny if he's spun out and caused her to wreck as well. That would have been the old 2 birds with one stone idea.

To clarify a common misconception:

Passing on the right is legal so long as the road is 2+ lanes in the direction of travel.

Passing on the right laws should be called passing on the shoulder laws.

I didn't debate that point. In Va, where I live, it is legal to pass on the right as long with 2 or more lanes and unfortunately I have to do it almost every day. My beef was with Bubba not containing his `neckrage and going off the rails...literally. I am also an aggressive driver but the 2 most important things in my life, my wife and daughter and getting older (wiser too?), has taught me it just isn't worth the anger, period. I did the 50+ mile one way commutes up to I-66 and the Fairfax/Reson areas for 16 years. I'm familiar with all forms of stupidity people exhibit behind the wheel.

for good or for awesome: Roads with intersections every few hundred yards don't have fast lanes.  I'm not going to weave in and out of traffic to make my turn just so you can drive a couple miles and hour faster than me.  Even if you are a big tough guy in a truck.

You could like try to be courteous in situations like that. it could even be argued that common sense says letting the dickheaded big tough truck guy go on past you actually makes YOU safer. But nah, kick the anthill. I'm sure you get something out of it.

She wasn't impeding traffic and she didn't cause him to tailgate or to later unskillfully cut her off.

No. There is no expectation of lane usage nor are there laws about staying to the right on roads like that. Making up rules in your head will only end up with your pickup truck sliding backwards into oncoming traffic.

BizarreMan: I'm not entirely sure who the jackass is in this particular scenario.

Not to excuse his actions but:

She claims that the road conditions are wet and slick so she doesn't want to speed.  Given the results of speeding and swerving being a crash, she may be correct.

There was apparently enough distance/time for her to get far enough past the car she was passing for him to pass them, cut to the right lane, and then pass her.  Plenty of time for her to get over, let him by, and then move back over to the left lane for her turn.

If it's so dangerous to be on the wet roads, taking care not to wreck.  It should be too dangerous for her to be taking one hand off the wheel and grab her cell phone.  At which point she then finds the app, and aims the phone in his general direction.  Even if she wasn't watching what was being recorded while driving.  That isn't safe driving.  It's damn dangerous.  If the conditions are so bad.

She says on the video and articles that she's made recordings like this before which tells me that she is a passive-aggressive left lane Nazi with AW tendencies.  I'm curious how many other videos she has on YouTube where drivers are being incited to road rage.

You aren't wrong and I was thinking much the same thing, BUT none of the above is dangerous in and of itself. The guy in the truck should have just passed her and moved on. Intimidating someone in your giant penis compensator is a far worse offense in my mind then what this woman did.

Very much this.

I passed a city bus, made a safe complete stop at the next light, but the bus failed to slow and slid on the ice taking out a tree.  I may be viewed as being reckless because I was going faster than the bus and passing it, but I didn't cause him to not slow down to make a safe stop.  He hit that tree all by himself.  Sure scared me, I was 6' to the side of that tree when he hit it.  I was able to look over at the driver as he hit the tree.  And I did not pass him at the last possible second, I was stopped at the light for several seconds before looking in my rearview to see him coming at me too fast and start thinking, "Oh please stop, I beg you to please stop."

Always amusing to see the Righteous Internet Tough Drivers scream about drivers who hover in the left lane, when tailgating is also illegal, and dumber and statistically more dangerous than hovering in the left lane.

Just because a driver is being stupid in front of you, doesn't mean you should be stupid behind him or her in response.

I always laugh when I am in town and someone hauls ass as soon as the light turns green.  I always make sure to applaud and congratulate them on winning the race to the red light.  I then profusely apologize for taking so long to arrive.  Best so far was the guy who "raced" me to 5 consecutive red lights.  I was very ashamed that I managed to lose to him so many times.  The cops even pulled him over to congratulate him (I assume that is why they pulled a U-turn and started up their disco lights.)

Never mind how fast the person behind you is wanting to go. If you're not in the rightmost lane and you aren't at least pacing the car directly in the same lane in front of you, then you're "slower traffic" and you really should "move right" as the proverbial sign says.

Oh lordy I love the amount of projection in this thread.  So many rootin' tootin' urban cowboys in their Ford F450's seeing their hero ditch his motorized penis trying to pass the blame for his moronic actions on to a woman in a minivan obeying the rules of the road.

Other than her filming a guy threatening her in his oversized pickup, she's doing everything else properly, including staying the course when faced with an aggressive driver.

That's what you get, cowboys.  You aren't traffic heroes for tailgating.

2014-03-28 10:36:45 AM
This. This is the reason "Slower traffic keep right" laws exist, and when they don't, you should consider it a rule of the road anyway. Sure, they guy was a dick, but that absolutely would not have happened if you had simply gotten over to the right. Don't want to speed up because of some BS "it's a rainy day" excuse (by the way, that might be a better sell if your wipers were on, your window wasn't rolled down and we couldn't see that it wasn't raining)? Fine, then drop back and get to the right. Oh, and driving one handed while you try to video the guy and stopping in a travel lane to get out and continue recording him *totally* sells you as the Patron Saint of Safe Driving, by the way.

OregonVet: I don't think 55+ in a 50 zone is hogging the left lane if you have a turn coming up.

She was going less than 50 (fast forward to the 37 second mark). Besides that, I can't find any reference to the posted speed limit in either the original vid or this newscast.

Aren't they timed so that, if you go the speed limit in the city, you can catch them as they are turning green?

Sometimes referred as a green wave.

She had ample opportunity to pull over and let him pass, he was an idiot for tailgating and slowing down to give her the bird, unless she sped up to try and prevent him from getting in front of her.

There were a couple of left turn lanes that I could see during that exchange.  When exactly was she going to turn?

Stop trying to control other drivers, that's what the police are for.  End road vigilantes.

Freeways work most efficiently when inside lanes are traveling faster than outside lanes.

Also, driving side-by-side when the rest of the road is clear is just dumb.  Who are you most likely to hit?  The ONLY OTHER CAR ON THE ROAD.

It was on the version I saw this morning on local (CBS) news done by that quirky old ugly lady that does like a segment per week. Can't remember her name, and I think she's syndicated, so she may not be on CBS where you are. I saw that part you mentioned, and also that she was passing another vehicle, so she may have been speeding even at that point. Before you pigeon-hole me on her side, be sure to check some of my other posts on her behavior.
