Should be free speech.

If not, should upgrade to a civil war cannon next time. You don't even have to load it with gunpowder, just stick it under their their little parking patrol vehicle and see them try to move it to drive away.

It's not assault, it's eggs.

Although they would go well with some assault and some apepper, eggs and rotten tomatoes should be constitutionally protected free speech.

One of the eggs hit the female officer, so she called for backup. When a police lieutenant responded, 10News was told he began to throw eggs at her too. Additional backup was then called in.

Did they become incapacitated when hit with an egg? OFFICER DOWN!

"I don't have time for this. I have school to do today," he said to the arresting officer. "I have school. That's more important."

You really should have thought of that before you started hucking eggs at a cop.

Totally unrelated:

Ingredients
You'll need at least one tomato per person, one egg per tomato, about a teaspoon of cooked breakfast sausage per tomato (or bacon or ham or etc per tomato), some steamed spinach (steamed asparagus or broccoli is nice, too), some dried Italian seasoning, basil, salt, pepper, etc

Directions
Cut the top off of the tomato and hollow it out, leaving a 1/4 thick shell
Press your favorite dried spices onto the inside of the tomato cup
Mix together a beaten egg, cooked breakfast meat, and steamed veggies
Pour the egg mixture into the tomato cup
Bake on a cookie sheet or cupcake pan at 375*F for 10-15 minutes

Serve with toasted bread, fresh squozen oj, and coffee.
Star jasmine makes a pretty and fragrant centerpiece.
Revel in joy.
You're welcome.

I was thinking the same thing. I can understand the parking cop, because she may not have had full gear for arresting a person with her just to put tickets on cars.  However, the lieutenant was responding to the call for backup and should have come prepared.

I dunno.  I've actually never lived in San Diego, but got ticketed there a couple times in the downtown area and one time was told by an SD meter maid to move on when i just moved to the side of the road to answer a cell phone call.  The side had parking meters (not a fire lane or somebody's driveway) but I wasn't gonna put any money in obviously, just needed a few minutes to deal with the call.

So, while I don't condone throwing eggs at people, I do understand where the hatred comes from.

2014-03-25 04:06:56 AM
Assault?  So what you are saying is that the kid threw eggs at the cop, but missed?  Remember assault is when you threaten a person, battery is when you actually make contact, even through a proxy such as an egg.  Though I guess if the egg struck the vehicle and not the person in the vehicle...

I have mixed feelings about parking enforcement.  I used to work parking enforcement back in my college days, and I am convinced that cities and public institutions intentionally do not put in enough parking spaces, because (A) parking facilities cost money, and (B) they make money off of parking tickets.  I worked for a campus PD at the time, and many of the things I saw the campus do, made me really angry.  For example, they actually closed off roads, and eliminated parking lots under the guise of a questionable "Green Spaces" campaign.  I believe then, and I believe now that the real aim was to increase revenue through paid parking and enforcement of said parking.  To make matters worse, our campus was located near downtown of a major city, and they pushed parking for the kids living in the dorms, far away from actual said dorms, so that the kids had to then walk at night, through barely lit parking lots, where it wasn't unheard of for female students to get sexually assaulted.  One girl even got her head bashed in by a guy with a rock, and nearly died walking through an unlit area to make the long walk from the parking garage to her dorm.

Well, to be fair, the real cops probably don't like the traffic cops, either.

This kid tries this with a normal patrol, especially with some cops who are actually liked by the force, and his teeth are gonna still be found in the gutter years from now. But the parking lady? The cops probably had to draw straws and the lieutenant lost so she had to go down first.

Traffic cops, especially in California, are the lowest rung of the LEO ladder. They're below park rangers and mall cops.

I'm in a quagmire.  I am a convicted felon with 3 DUI's from which the last was only 3 years ago.  I am what I guess you could call a 'rehabilitated' person.  By that I mean I will never, never, never, go back to jail.  I am fully competent and 100% conscious of myself and my past actions.  I have a true disdain toward people I learn steal, cheat, rob, lie, harm other people. Which I struggle with because as much as I am quick to judge and hate other people that do bad things; I have to remember once I was young and dumb too.

In Maryland, you are never arrested for "battery", as there is no law on the books called that. Here assault is defined as all the crimes known as "assault', "assault and battery" and "battery". I am way too tired to look it up, but if California is similar, then it would be correct to say he was arrested for assault whether he hit or not.

I know, Adam Carolla was tearing into the traffic cops in LA once, really with an extra heaping of self centered rich guy entitlement and horrible language. Then, a cop called up and said "You have no idea. We hate those dicks, too."

A good time was had by all... except traffic patrols.

Assault can cover lots of things other than bodily harm or injury. e.g. A person intentionally driving through a puddle at speed to soak pedestrians could be charged with assault in many jurisdictions.

drxym: Assault can cover lots of things other than bodily harm or injury

The modern legal definition of anything is not proof of its morality. Indeed, it's often the direct opposite. Especially in California.

In this case, it is very disrespectful to toss eggs at a uniformed police officer, but it is in no way life threatening unless the officer in question has some kind of rare albumen allergy in which case why are they allowed to be an officer. On the other hand, issuing traffic citations that must be paid before they can be contested in a court of law? That's simply highway robbery. So we've got a punk kid making a statement and a robber literally robbing people using the aegis of a uniform to get away with it.

I don't care what the legal term is, it's not morally assault and thus it shouldn't be prosecutable under that statute. Not that it shouldn't be a crime to toss eggs at people without a good reason. But I think calling it assault is retarding the advance of society. It's littering and wasting food. Send him a bill for the dry cleaning and sentence him to a few weekends scrubbing sidewalks with a deck brush.

My asshole parking enforcement guy CSB:

I was putting in a camera system in a new hotel being built near downtown Norfolk. The only place we had for parking was three Goddamn blocks away. And I had about 250 lbs of equipment I needed to off load. So I parked on the street near the building just long enough to drag everything in. The place I parked was in front of another private parking area. This area had two road access spots. I parked partially in front of one access spot, but there was already a construction barrel blocking that part of the ramp anyway and there was still plenty of space for a car to get through. At least a car and a half wide.

I was there for all of 8 minutes. Just enough time for me to haul everything inside to the foyer, and was heading out to move my van when parking enforcement shows up. This guy rolls up in a pickup like farking SWAT. He comes flying up and then comes screeching to a hault just behind my van, blocking me in (and completely blocking the entrance to that side of the parking area. He jumps out with his buzzcut and parking enforcement polo shirt, and hangs a badge on a chain around his neck like he's Will Smith in Bad Boys. And he looks farking pissed. "THERE IS NO PARKING HERE! YOU ARE ILLEGALLY PARKED!"

I tried to explain I was working on the hotel and I just needed to drop off my equipment, and I would be moving right now. "You're not going ANYWHERE sir! You will NOT move your vehicle until I have completed writing the ticket." I ask him why parking on the street just long enough to offload my stuff was such an issue. "You are BLOCKING the entrance to this parking area. No one can get in or out!" I point out that not 40 feet away is another entrance exit to the same parking area, and that it was *his* vehicle that was currently blocking this exit." He got really pissed. "Sir. DO. NOT! Argue with me. You are WRONG! You CANNOT BLOCK THE PARKING AREA!". I, still calmly, ask how it is I am blocking the exit if I am parking in front of a construction barrel that is already blocking it"

I didn't think he could get any angier. "This barrel??? This is an ILLEGAL barrel!" Uh, an illegal barrel? What? "This barrel CANNOT be here! Now, guess what? I am going to confiscate it!" And with that he picks the barrel up and tosses it in the back of his truck. And just stares at me.I tell him 'Uh, that's not my barrel.' He says "You're damn right! It's the CITY'S barrel now! It is now city property and if you touch it, I'll have you arrested for theft." I tell him "I don't think you can just lay claim to things like a feudal lord" He says "Well guess what. THIS barrel is now city propety too!"  and grabs the nearest barrel which was marking a huge chunk of missing road. Again I tell him that's not my barrel and he says "That's right, and it will never be again!"

He then gives me stink eye while he writes up the ticket and proceeds to tell me all the horrible things that will happen the second it doesn't get paid. (Apparently they will send someone out to arrest me the day after the payment is due) and that he is going to go confiscate all the other 'illegal barrels' (of which there was probably about 50 with all the road constuction) and that if I was still there when he got back, my car was getting towed and I would be arrested for tresspassing.

Later on, when I was getting ready to call in and pay for the ticket, I noticed he wrote my licence plate down wrong. (used a B instead of a D). I considered not paying it, since that was the only idenifying thing on the ticket (he never asked for my ID, and didn't put the VIN on it), but the thought of Captian Parking finding me again just wasn't worth the hassel.

That dude seemed really angry and I have no idea why. Plus he seemed to think that he was THE end-all of parking enforcement.
