Probably won't fly. If the kid wasn't attacking him or threatening him, then even in his house it'll be unjustified. Also there's the fact that the kid had permission to be there from his daughter. That matters, in terms of the law when it comes to intruders. If someone breaks in to your house, different rules apply that if someone was allowed in your house. That includes when someone else who lives in the house allows them in.

He may be able to get off, but I kinda doubt it.

It'll fly because the girl told her dad he didn't know her. Far as he knew, a rapist had snuck into his house. He didn't know until afterwards that the daughter knew the guy.

Anyone can become a trespasser at any point after being invited into a home.  All it takes is for the legal inhabitant to let the individual know he or she is no longer welcome. An invitation is not coated in magical protection dust.  The legal inhabitant, however, should give the newly christened trespasser a reasonable chance to vacate the premises, depending on your jury.
