Even the people that were close to the old man understood the situation for what it was -- a misunderstanding. Get over it..

FTFA:"Westbrook knocked on the door and tried to enter to Hendrix's home in Chickamauga, and was then later confronted Hendrix outside the home.

Hendrix then shot at Westbrook when he felt he was being physically threatened. Westbrook was fatally shot once in the chest.

The 911 call came in about 4:00am on November 27, 2013 from a home on Cottage Crest Court. Investigators say 34-year-old Joe Hendrix of Ooltewah shot Westbrook who had been walking around the outside of the home for several minutes and repeatedly ringing the doorbell."

That is not self defense, that was not standing his ground, that was some asshole looking to use his gun.  He exercised very poor judgement and decided to be a tough guy rather than lock his door and call 911 immediately.  There was several minutes between initial contact to shooting.  This is murder through and through.

I mean...this mothafarka actually left the relative safety of his domicile...with his farking gun and the local DA is still refusing to prosecute him?  WTF Georgia?

Yeah, it's perfectly normal to expect a 72 year old man to kick your 32 year old ass.  I would be afraid too.

He was probably coming right at him (very slowly).

A 34-year-old man felt so threatened by a 72-year-old man walking around his home at 4 AM that he went outside with a gun? Bullshiat!

I would have called the cops and hung out inside my locked house with my guns. If he came inside somehow, I might shoot him or asked him why he was there.

If Georgia has a homestead law or property-based castle law like Mississippi or Texas does (Thief in the Night law), he could be protected.

Still a cowardly asshole.

FTFA: D.A. Herbert "Buzz" Franklin sent a news release Friday, explaining the details surrounding the case that touched on the "stand your ground" laws that are on the books in some states.

Are they on the books in Georgia?  What the fark difference do "some states" make?  "Some states'" laws do not apply in Georgia.

That's the critical part.  When the killer initiated the confrontation, he lost the "self defense" and "stand your ground" claims.

Hey look. A troll, or an idiot with a "IM THE DECIDER MENTALITY!"

The gun is to defend yourself WHEN he breaks in. It is not to engage in a hollywood gunfight with someone in the dark of night outside your house.

Until then, you stay down, stay quiet, and wait for the cops to get there. You only use the gun when confronted. You don't go out like Ahnold.

Exactly, I hope that this is a start of a trend.  Gun owners shouldn't balk at standing their ground, not everyone they shoot will be an "innocent victim".

Yeah, I'm sure the neighbors and police will appreciate guns fired outside and not at a range because just like in the movies, bullets that don't hit the bad guy always harmlessly ping into a burn barrels or ubiquitous stacks of crates containing lettuce. :|

You'd be such a hero that they'd want you kicked out of the city.

part of the defense should be if you felt scared. if someone was rattling my doorknob and ringing the bell at 4am i wouldn't have the guts to open the front door. i sure as heck wouldn't look out the windows and say to myself oh good he walked into the back yard so now i'll confront him.

I'm a gun nut, and fark this guy. He went outside because he obviously hoped he'd be able to shoot someone.

I always have access to my gun in my house, and if someone keeps ringing the doorbell I'm gonna assume it's someone crazy, drunk, or senile and call the cops so they can come get them. I'm not gonna go outside. It's for if someone actually tries or succeeds to break in.

If the guy wanted to see who it was he could have called to the guy from inside the doorway to see what was going on. Then if the guy attempt to approach shut the interior door. If the guy attempts to break the door down or something only THEN is there reason to consider using a firearm.

So no 72 year old 6' 2"  300 pounder  vs. a 32 year old 5'2"  120 pound guy ? I'm only guessing and I suspect you are too as TFA doesn't mention it . How do you know he wasn't a criminal just because he had Alzhiemers  ? He  (seriously ) could have already had these kinds of behaviors . TFA does not mention it one way or another .

No, I would have opened the door (after seeing an elderly man shivering from cold with a dog he was walking no less) and let him in if he was in dire need (as he was).

I'm against letting old people freeze to death and I'm unafraid of most people.

If he didn't "get it" after explaining he's in the wrong place, it may be time to  ask him to check his wallet for the address.  Calling the police would happen if he got punchy or kicky.

Alzheimers patients can be scary in that they can be loud and they don't really know their own strength.  When my grandfather was starting to lose it he rolled a riding lawnmower on it's top so he could sharpen the blades easier.  (As a side note - don't do this because it causes the oil to flow to the top of the engine and then when you go to start it you will destroy it from lack of usable oil).  He also liked trying to escape from the house on the farm and 'going home' to a house he hadn't lived in in 40 years and had been long ago torn down.
