This is some thing all small businesses should do to cover the massive expenses that are coming with this terrible law.  Obama, Reid, and Pelosi should be prosecuted for consumer fraud over the ACA.

Maybe it's just me, but I'm comfortable paying an extra twenty-two cents on an order of wings and a pitcher of beer if it means I can be reasonably confident I'm not enjoying the chef's scabies or the server's flu as a side dish.

Assjacks like the owner of this place, though, deserve to spend eternity at a low table next to the broken-down (but still utilized) men's room under the only TV with working speakers during the combination World Cup/Mexican Chili Cook-Off final while Gordon Ramsey audits their taxes.

I farking hate restaurants with TVs in them. The make perfect sense in a sports bar but having seven different TVs running while I'm attempting to enjoy a steak and a conversation without constantly being advertised to ruins the experience.

I just looked her up. Her daughter's story is tragic but the gist of her complaint is that they already have a hard time implementing all the free medical care they get from the government and she's certain that the ACA is going to make it worse. Not that it has gotten worse, not that she sees evidence that it's going to get worse, simply that she's sure it's going to get worse. She doesn't go into any of the details of their insurance situation, beyond the fact that their daughter is receiving Medicaid, but I'm sure they will bravely refuse to investigate insurance options should the need arise in order to register their disapproval of the socialized medicine they are already receiving.

bluenovaman: Sounds like someone needs fraud charges.

/I'm only a lawyer on the Internet.

May be a bit disingenuous on their part for charging a fee for an expense that has not yet been incurred (starts 2015), however, they do post notices of the extra fee on both signs and separately on the receipt so it's not like they were unaware that such fees occurred or that an attempt to deceive has been made.  Consumers still have the choice to not eat at this place if the extra .10-.15 a meal is going to be the deal breaker for them.

Unless you prove that systemically that the management of these establishments were either burying the extra charge or outright lying about having to impose the charge if asked about it, fraud would be difficult to prove.

Sleazy sales tactic? Maybe.  Political whore-mongering to call attention to what the owners believe will be additional costs resulting from the ACA?  Most likely.  Fraud? No.

From the example receipt I saw in a previous article, it appeared as though they were adding the 1% after the subtotal and sales tax. So, not just fraud but tax fraud. A bigger, better can of worms they have opened up for themselves.
