He's not white. There's a shocker.

They also suggested that he could have been on marijuana, a drug that wouldn't necessarily show up in a test.

Even a blood test? Horseshiat.

Damn straight.  I'm one coordinated sumb*tch, but I'll be damned if I can close my eyes, stand only on my weak-side foot, on uneven ground, in the wind, with cars whizzing by, lean my head back, put my arms straight out, and alternate between straight arm and ring finger to nose back and forth.  That bullsh*t is straight-up made to get convictions, whether or not the person convicted was actually intoxicated.

Evidence?  What more do you need?  Look at this guy!  He can't even hold a warrior 3 pose with arms overhead for 3 minutes while standing on this patch of ice on a hill......  Oh wait, Goddamn.  He did hold it for 3 minutes... Well, he looked a little shaky there towards the end...  GUILTY!!!

The Austin Police Department stands by the arrest, saying they believed Davis showed signs of impairment, that while standing on one leg, he "swayed," and "needed his arms for balance."

So, having a balance impairment is an arrestable offense?

I guess I am struggling a bit with why people are assuming that this type of action, whether it is just over zealous cops or racial profiling, happens only in Texas.  This type of activity happens in every state of the union.  It is always funny to watch the insecure mouth breathers come over the top anytime anything, including nation wide problems, happens in Texas.  And yes, I know part of it is because Texans, like myself, tend to react when idiots make idiotic comments.

To be honest I don't see the problem here IF and it is indeed a big if;

A) The arrest is expunged
B) His legal costs are reimbursed
C) A small settlement for his inconvenience is given and in a perfect world it would be garnished from the wages of the officers who arrested him

The police should have the power to remove any driver from the road under a suspicion of intoxication.  There are hundreds of ways that a person can impair themselves and only so much room for testing kits in a cruiser. The officers in this case stepped way over the line but legislating the need to have a positive test for an arrest would be a mistake.

Forbidden Doughnut: August11: Will there ever be a news story that would make anyone on the coasts want to move to Texas?

I *did*read an article about how Texas has attracted many people due to the job market and a lower cost of living...

/ still not going to move there, most of it looks like a barren wasteland compared to the Pacific Northwest...

I kinda like the landscape. It is the people that concern me. I've known five Texans. All five are some of the best people I have ever met in my life. Any simple question about why they are no longer there will be answered along the lines of they had to get the hell out. So who did they leave behind??

That's a reference to the chief in Texas, who while defending officers for arresting a jogger for jaywalking implied she was lucky she wasn't sexually assaulted by police like in other places.

For the last time, that's not what he said.  He was exasperated about the situation being blown up as much as it was, and said "Man, other PDs have to deal with farking sexual assaults being committed by their officers.  If this is the worst scandal that my department has to deal with, I must be doing something right,".  I distrust the direction that police are going as much as anyone, but lying about this sort of thing serves no one.

doglover: Texas first. Then LAPD, then Chi town

Texas has its share of good ol' boys bullshiat, but it has  nothing on Chicago.  And actually the cities in TX are relatively clean, we've just got more rural areas and thus more of the small-town bullshiat that exists in small-town everywhere.  Chicago has had its police force  literally working for organized crime at one point.

All that said, the larger point being ignored here is that anyone that thinks any state but Louisiana comes out on top for anything corruption-related  really hasn't been paying attention.  Works commissioners having a literal fridge stuffed with cash for and from under-the-table dealings  barely even made the news in-state there.

Specifically the chief in Austin, Tx.   What's the deal with Austin pd?

Austin is full of those hipsters that are always insisting that not all of Texas is awful. The PD is full of people that are pissed off with hipsters trying to make Texas not-awful.

I understand that you are just trying to a good job officer, but in times like these I've been advised by legal council not to answer any questions; I do not consent to any searches; I do not consent to any seizures.

If a cop tries to talk you up after you sign a ticket just leave as you are free to go.

And they held him for 2 days, just to make sure he recovered from what ailed him. After all, I'm sure they had a doctor/medic come in and ensure that he was ok, right?
