In this case I believe he means a roadside breath test, something which has yet to be reliably done for someone on marijuana

An impaired coordination can certainly be arrestable if you're driving.  Many people with balance disorders cannot legally drive because their condition impairs their ability to drive safely.

He wasn't charged with DWI, he was arrested on suspicion of DWI.

As an Austinite who has taken defensive driving several times, it wass always explained that one can still be cited/arrested for some variant of DUI, regardless of any and all roadside tests.

If the cop feels you are a danger on the road, you are probably going to jail for the night.

None.  That's why he was released the next day.  No judge was needed.  He consented to the blood test, so no need for a warrant.  And he wasn't held for more than (24/48/72) hours (it varies depending on jurisdiction and offense) so there was no need to take him before a judge.

If a cop tries to talk you up after you sign a ticket just leave as you are free to go.

Damn straight.  I'm one coordinated sumb*tch, but I'll be damned if I can close my eyes, stand only on my weak-side foot, on uneven ground, in the wind, with cars whizzing by, lean my head back, put my arms straight out, and alternate between straight arm and ring finger to nose back and forth.  That bullsh*t is straight-up made to get convictions, whether or not the person convicted was actually intoxicated.

Evidence?  What more do you need?  Look at this guy!  He can't even hold a warrior 3 pose with arms overhead for 3 minutes while standing on this patch of ice on a hill......  Oh wait, Goddamn.  He did hold it for 3 minutes... Well, he looked a little shaky there towards the end...  GUILTY!!!

And if you pass it they'll just make you take it again. We just had a story last week about a guy who was made to take the FST SIX TIMES.  He passed every one and they still arrested him.
