The fact that this seemed like a good idea should be evidence enough of what it is, exactly, when we talk about "rape culture."

Well if we're going down that dirt road, I could probably argue that women that refuse to work with prosecutors to imprison their rapists are contributing to the "rape culture".

No shiat.

I took one for the team and clicked the Jezebel link.  Actual story:

"The 43-year-old woman - the victim and prime witness in the case - has not been charged with any crime. She just wasn't showing up for pre-trial meetings with prosecutors, despite promising to do so several times. So earlier this month they obtained a judge's order for a material witness warrant. It's a little-used procedure under state law that allows police to arrest a witness of a crime to ensure they show up for court. Chief Criminal Deputy James Smith said such warrants are rare and requested only "as a last resort."

Of course they worked the whole RAPE VICTIM ARRESTED angle.  Douchebags.  If they had dropped the charges because the only witness wasn't showing up to cooperate, I'm sure it would be RAPISTS SET FREE!

Keep driving those page clicks Jezebel.

Tell me, Jezebel, just how strident would your yelling have been when prosecutors dropped the charges against her alleged attacker, all because the victim (and most important witness) in the case just didn't bother to show up for hearings?

2014-02-24 08:32:56 AM
So the woman pressed charges, then refused to cooperate with the investigation?
Can't say I'm exactly surprised she got arrested. It's not like she got arrested for being raped, she got arrested for hindering a criminal investigation.

For now I'll just say this - couldn't they have at least put her up in a hotel, as is sometimes done for witnesses,

Man comes home. His wife isn't there, and she doesn't show up that night. Next day, the man's getting worried because his wife doesn't show up, so he calls the police to file a missing persons report. Next day he comes home, finds his wife scarfing down a sandwich.
"Honey, where have you been!!" he says.
"I'm sorry, honey, I was kidnapped and raped by 5 men for a whole week!" she responds.
"But you've only been missing a couple days...?"
"Yeah, well, I got hungry..."

Not really. She's not being charged with any crime. She was arrested only to ensure that she would be present to testify against her rapist.

Well, considering how much the RadFems scream about 'rape culture', evicerate prosecutors who even question a victim's veracity, and defend false accusers, they should've expected this action. I mean, if a mean if a prosecutor can be publicly harassed, it's about dang time a complainant is tossed in the pokey for refusing to follow through.

Fools, hoisted in their own petard.

Speaking of their page clicks....at least on mobile, there is no way to go to the next story without clicking back to the front page first on any Gawker Media site. That would be like having to go back to the main page here before each comment page. I started losing interest a few years back when they got rid of excellent writers. Back then they had a lot of stories before other sites - now they have them 1-4 days later. And the change in their commenting system caused the thoughtful, most intelligent commentors to disappear.

Let me point out that this woman was homeless and theorize that arresting her is *doing her a favor*. She will be provided with meals, a warm place to sleep and clean clothes.

I doubt she fought the arrest and may have even asked to be arrested. Homeless people will sometimes commit minor crimes just to get arrested when they need something the system can provide.

At the very least they sure are making it difficult for the people who can actually fix said "rape culture" to accomplish anything.

Look, I sympathize with the woman: I'm sure talking about such an awful traumatic incident is not pleasant.  However, if she doesn't do so there's a very good chance the people who inflicted that trauma will walk free and go rape someone else. Prosecutors need to make sure she follows through not just for her sake but for the sake of women in general. It's a brutal bit of cost/benefit analysis, but it's not without justification.

Retarded article.

The woman wasn't showing up to help prosecutors prove their case, her case, thus they had to result to legal measures to ensure that she shows up.

They'd have done this to anyone regardless as to gender.

But don't let this get in the way of your outrage, Jezetard.

When you've been told to appear in court in any capacity (accused, jury member, or witness), they may or may not be nice about it, but it isn't a suggestion or request.

Dang, Jezebel writer. Tell us how you really feel.

It sucks, but I can kinda see the prosecutor's side. If the witness is refusing to show up and testify, you can either arrest the witness for presumably a few days or let a kidnapper-rapist go free. It's a rather draconian measure to be sure and I'm not sure I like prosecutors being able to do it, but it's not proof that everyone involved in the case is somehow a rapist sympathizer, as TFA's writer seems to be claiming (it's a little too incoherently strident to really follow, honestly).

Cerebral Ballsy: rape PTSD

Rape affects different people in different ways. Some people can bounce back the next day, having no problem knowing that the rapist is an asshole and it's in no way their fault, and they have no trauma about being an extended victim. Others don't. It is always best not to make assumptions.
