He'll probably get off on the alcohol part, Florida's zero tolerance starts at .02.

They must have a really good case for improper vehicle stop though, with the tox screens coming back positive on THC/Xanax.

Florida's zero tolerance is anything over 0.000 for anyone under 21. He's dumb for not taking Back on Track, which is Miami-Dade county's slap on the wrist for first time DUI offenders.

For BoT they sign an affidavit admitting they did it, then they do some classes, probation, and some fees and the arrest shows up as a reckless driving on their record if they complete everything. If they "bounce out" they get hit for the DUI with an affidavit in which they admitted they were DUI.

They keep quoting the "GPS only showed him doing 27 MPH" line but it all comes down to how often the GPS polled and whether it is an instantaneous reading or peak. If it polled every minute and recorded instantaneous then that is easily enough time for a Lamborghini to go from 27 to a hundred and back to 27, as a drag race would be, and show nothing but 27 on the record.

Third times a charm I guess...

Legal limit 21 and over = .08
Legal limit under 21      = .02 ('Zero tolerance' limit)

He has every reason to reject the plea, he wasn't legally drunk. The big issue remaining here are the tox results showing THC and Xanax (and the admission of using all three). If they can actually "prove" (term used loosely) the car wasn't going over 27 mph, then the stop wasn't warranted and the tox results are nullified.

Looks like Bieber didn't have that much alcohol in his system. It might or might not have potentiated the Xanax to a noticeable degree, but if it was noticeable, it would still have been slight. Just based on personal experience, the cross potentiation reaction also occurs with marijuana and Xanax. You will be pretty farked up. You may or may not manage to stay awake. Operating a motor vehicle in that condition is remarkably foolish, and he's lucky he merely got a DUI bust out of the deal, rather than a totaled Lamborghini Douchetardo and a trip to the hospital to go with it.

Do you mix it with other mind altering chemicals when you take it, and then drive? By itself, that dose is going to produce slightly more than normal lack of affect, and if I were already tired, might exacerbate that fatigue. Add a decent-sized dose of another drug with CNS depressant properties, though, and I'd probably achieve near-catatonia, and start to drool on myself.

Additionally it is very hard to prove whether a habitual user of drugs is "under the influence" at a particular point in time based on tox results. A non user can take one hit and be hallucinating while a chronic user will still have more nano grams in their sample even having not smoked in a week. With a good attorney the case might not even survive through a motion to suppress.

Mugato: StoPPeRmobile: Wasilla Hillbilly: The Xanax thing is also dependent on tolerance. I take 2mg 3 times a day and can drive fine.

Hey, I've heard that before, from drunks.

And some of them can.

Professional drunk here.  I never drive drunk anymore, because I know even if everyone else might think I am sober, I know my reflexes and thought processes are impaired.

And while I can toss back 4 double vodkas and and three patron shots in two hours, and be perfectly coherent, if I smoke some weed, drink some beers, and pop some pills, the synergistic effect will knock me on my ass.

Luckily, I got through some scrapes without killing myself or anything that made me realize that if I tipple or get high, behind the place is no place to be.

lindalouwho: Mike Chewbacca: lindalouwho: But he did rake in 58k from June 2012 thru June 2013

Somehow I doubt that.

As well you should lol!

What is 58 million dollars, Alex.

/ don't drink, but was up waaay past my bedtime last night
// that's my story and I'm stickin' to it

You were right the first time and the snark wasn't warranted.

Of COURSE if Beiber made 58 Million, at some point, he did, in fact, make 58 thousand on the way.

So you are correct.

italie: groppet: italie: Mugato: Bieber's douchitude aside, getting a DUI for a .014 is bullshiat. How do you drink anything and only have a .014? I realize he's not 21 and shouldn't be drinking anything but I thought the limit was .08.

//Douchitude aside

In DC you can have a .001 and if the cops pull you over for a right turn on red and you blow that, you get a DUI

Would have been nice if he was in DC then....

Doesn't matter. He was under the legal age to consume alcohol in this country. Period. End of discussion.

Got to admit I'm not following this too closely, but if what I read on the last Fark link from TMZ is true he'd be an idiot to take the plea deal.

Maybe it's time someone reminded him of this fact.

Barack Obama is black, your point?

/really torn, using Michael Jackson, but,

Not really, he's half white, but pretends too be full black. Just another whigger

Well case dismissed then. If only the prosecutors in Florida were as smart as you.

Really, we are all black, it just faded over the years.
Here we can use M Jackson, eh?

/or at least that is the current consensus that has some, barely understood science behind it

forgotmydamnusername: Wasilla Hillbilly: The Xanax thing is also dependent on tolerance. I take 2mg 3 times a day and can drive fine.

I take an assortment of prescriptions on a daily basis, but Alprazolam is the only mind-altering one (unless you count Zoloft). Aside from prescriptions, I smoke weed on a regular basis and drink alcohol rarely (once or twice a month). When I first started on Xanax 0.5mg would make me stumble around a bit and act a little goofy. Now 2mg literally does nothing recreationally, but still keeps my stress in check. If I take 4mg at once, I would definitely feel that, but very briefly, 20 minutes or so.

I actually find it a bit puzzling that Xanax is so popular, although it does work great combined with weed if you are prone to paranoia and/or panic attacks.
