If you read, he isn't protesting a fracking operation directly.  It is a company erecting a 160ft water tower to supply the large amounts of water needed for fracking and the traffic that will bring in the area lowering his property value.  It is a slight difference and still somewhat hypocritical, but it is a definite nuance to the argument.

To play the devil's advocate, a lot of factors. Is it noisy? Does it require trucks to haul things with? Does it mess with the landscape or view? Basically it is a case of NIMBY IMO.

Now now.

He's not complaining about the fracking per se. He's just worried that the tower that will supply the water for fracking operations will cause his property values to plummet. He's not even going to be near the fracking site, so why would he be worried about any environmental repercussions? He's just--rightly--concerned that the noisy, ugly water tower, and increased highway traffic near his $5 million property, would affect his property rights.

It's an important distinction, because this asshole's lawyers have included an argument that this warrants an unjust taking without fair compensation (because it reduces the warranty of quiet enjoyment to their property and reduces the valuation) and they should be compensated for it. An interesting concept which opponents of fracking might consider imitating if this joker wins. I can hardly care if his $5 billion grupnik property is inconvenienced by a water tower or not...but I approve of any new weapon in the war on unrestrained fracking.

Disclose every goddamn chemical you're pumping into the ground, or STFU. Corporations cannot be trusted to regulate themselves, because, as has been proven time after time after time, they WILL cut corners and put people's lives in danger for extra profit.

Look at the state of China's air, or India's rivers, or America in the late 19th/early-to-mid 20th century. THAT is what Republicans are proposing when they say businesses need "less regulation".

As much as I would enjoy seeing this asshat hoisted on his own petard, the only real point the lawyers make in the lawsuit is that the road in question (Farm to Market road 407)is not designed for heavy vehicle traffic.  The stretch near Bartonville is a fairly narrow two lane road.  I, personally, refuse to drive that stretch in my little compact car ever since a tractor trailer doing 65 MPH blew my tiny Ford off the road and onto the shoulder.  My car, with a full tank of gas and my fat ass behind the wheel, only weighs in at around 2700 pounds.  Traffic on FM 407 is bad enough that I do my best to avoid driving that road at all... which isn't easy when most of the retailers, grocers and restaurants in this area are on FM 407.

The dirty little secret is that big oil would love to kill fracking and prevent any new drilling. Their profits are maxed and new oil sources can only hurt. That's why they lease oil fields and sit on them. It would be a lot easier to drill those and not screw around with the fracking but they engage with that so others don't have it. But ban it completely and they'll be very pleased.
