Because the only thing they could ever get him on was Tax Evasion - IIRC they seized his assets and then sold them off to recover the losses.

He died destitute from Tertiary Syphilis.

This is it found by way of Zillow, with additional pictures.  No mention in the listing that this was once occupied by Al Capone.  Odd, considering any respectable Colombian drug kingpin would shell out the asking price just for the shouting rights to Capone's home.
