The defendants' attorney Michael Thomas argued in his brief that the Yeagers' properties were never annexed to the association and that the couple has not requested nor have they ever received any services from it.

Now I want to form an HOA and go around annexing neighbors. I could be like a city annexing highways to run speed traps. "Your yard has been annexed to my HOA. You let the grass grow over 3 inches. I had somebody mow it last week and you owe me $1,936 plus a lien release fee."

As a judge in the court of public opinion, I find for the defendant. In the first place, he's incredibly awesome. And secondly, he maintains his innocence. And this is a guy who acknowledged in his autobiography that he committed war crimes by strafing civilians during World War II. So I think he'd cop to HOA membership if he were guilty of it.

Case dismissed.

So, there's some sort of dispute if the Yeager properties were ever annexed to(into?) the HOA. That should be pretty easy to establish. Did he sign into the HOA or on any annexation agreement? No? Find for the defendant, pay for his council and a $50,000 fine for wasting my time.

I know a fair amount (i.e. enough to get smacked down on Fark by someone who knows way more) about HOAs and the Uniform Planned Community Act, and I've never heard of a way that an HOA can "annex" a property.  The development either has the ability to create an HOA (based on the CC&Rs in the deed), or it doesn't.  Developments can't arbitrarily extend themselves to properties not originally on the deed, at least as far as my research has shown.  Maybe an amendment to the deed that includes properties that were in the planned community but were left off as a mistake-in-fact?  I can't see any other way that would work.

As seems to be the growing tradition in the "press" these days, TFA is big on outrage inducing keywords but low on actual facts.

Chuck just bit off more than he could chew. Fighting Nazis, shooting down jets in a prop plane, flying faster than the speed of sound in an experimental plane that no one knew would work. Those are child's play. You should know.. You had better know... you don't mess with HoAs. That's like challenging Satan to a fiddling match. General Yeager is pretty well known to be a real A-hole..I thought that maybe it was part of that "I was doing my duty" Greatest Generation thing kind of shrugs off his record..Based on the Farker
encounters, it sounds like it's just the opposite. None of that takes away from the amazing things he accomplished and did in service to the country..But he could be less of a douche about it...

Back when I was a Realtor I sold a house to some friends & a couple of years ago they got a notice that they owed a lot of money to the HOA for road maintenance etc....
The only problem is that the title search turned up no HOA at closing, no road maintenance agreement, nothing. The title company we used is closed, but we know where all the records are (the company that took over) so I told them to go there.

Bottom line is the asshole that's doing this to them (I know him, he's a sleazeball "developer") has forged papers that he's trying to get the court to recognize as legit.

No resolution yet, I should call my friends & find out how it's going.

I seem to remember a story where when he was in Korea, his squadron got a new version of the F-86 that was supposed to be faster, so he had the ground crew take one of the old ones and take off the engine limiters so he could run it at over 100% thrust, and then he raced it against the new one and won.

have a coworker going though something like this. where she live someone bought up all the land on both sides of her as well as the land behind her.  A HOA was built and ever sense then they have been giving her trouble demanding that she pay the hoa dues and follow their rules.  She just waiting for the day that she gets paperwork form them to try and force her to join the HOA.

I actually got a great picture of him that day, and was told I could mail it to him and ask him to autograph it, but I chickened out. He was that intimidating to my young self. I have it in a frame with a vintage USAF bookmark I found in a book at Goodwill that says "Mark Your Place In The Age of Space!"

Was he driving a silver blue 'vette, Beale SF guy?
