Okay, I was gonna make some snarky "responsible gun owner" quip here, but holy shiat - how much of a douchebag do you have to be to randomly find a stranger that is working and dump beer on them? That's not a prank, that's just being a downright shiattastic person. Also, totally not buying the "my friend was totally the one drinking, I swear!" You're not only being a huge douche, but you're also drinking and driving.

Why aren't those two in jail, too?

Babwa Wawa: There are lot of folks in this thread with interesting ideas about when and where lethal force is justified.

Many of you are farking nuts.

For me, it's the old "I don't condone it, but it I understand it" line.  Don't want to get shot at?

Don't throw shiat at people from your car.

Was this article written by the "pranksters" attorney?  How do you pour a beer on on someone from a moving vehicle?

If you throw a bottle at someone, isn't that using a missile as well?  People have died from bottle attacks.  I hope his attorney pursues the pranksters as a hate crime as well.

Clearly a little shooting back was just a harmless old man prank, these tightass kids don't understand humor, they need to realize a prank is just a prank.

Didn't they hurl a missile at him (Second time, they threw a beer at him)?

"He threw the bottle of Budweiser his friend was drinking at Estrada, then hurried home, according to the report."

Guess a can of beer is the poor man's missile.   Wonder if you need a CCP for a can of beer in Floriduh.

You are allowed to use a gun to make a citizens' arrest, which is what he was attempting to do.

He chased them down and shot at them for pouring beer on him.  Is that in the realm of "citizen's arrest?"

It could be interpreted that way. Honestly, can you say you wouldn't have done the same?

That's what stood out to me as well.  Something tells me that if he had fired an actual missle into the vehicle, this story would have had a much more different ending.

You guys do know "missile" has multiple meanings, right?

This story is surprisingly amazing!  The two guys who were drinking and driving, assaulted a guy, and reckless driving apparently not charged with anything at all.  The guy shooting charged with firing a missile at them, and his excuse for shooting at them was "it was coming right for him!"

This is exactly what I find to be horrific.  The response was entirely out of proportion.  Shooting at someone because you got beer poured on you is not "understandable".

There's a difference between understanding why someone does something, and condoning it. That's why he said "I don't condone it". Adding on, "but I understand it", doesn't mean, "but I do condone it really". It means he understands that someone was extremely pissed off and in a moment of blind rage reached for his gun. It's not nice, and no one likes it, but how can you say you don't understand why that happens? Blind rage makes people act stupid and violent.

Nothing I said is mitigating or condoning shooting people because you're angry, in any way.

Cowards like that don't usually have the balls to gamble with a jury.

So he'll plead out, do 5, maybe 7 years with good behavior.  Then again, he does have low impulse control and an murderous angry streak, so the good behavior part might not be in his future.  He could be looking at 10 to 15 inside.

And if you are on the jury, what do you give the two who "spilled" a beer on the man?

Drunk driving, underaged drinking, criminal mischief, assault... oh, the shooter was hispanic? That explains the one-sidedness.

I can, honestly, say that I wouldn't have done the same. See, I don't own a gun, so I wouldn't be in a situation where my injured pride lead me to rage-murdering a couple of douchebags. Or better, winging one and then spending time in prison, and/or paying out a huge settlement in the civil lawsuit they bring against me.

I'd rather be filled with impotent rage for a few months, and then get on with my life.

I don't get the confrontational part.

If he had caught up with them, why not just hang back and follow them to their domicile.

Then you can have all the revenge you want - banana in tailpipe, tuna in mailbox, pizza-calls,TP, mayonaise under car handle...

Yeah, I do.  I know what context their using it in as well.  I just always found that charge to be a stupid way of saying shooting at someone.

I think it's because he wasn't shooting at someone; the law (using Virginia's equivalent) is firing or throwing a missile -- throwing rocks, bottles, or snowballs counts -- at a moving car on a public highway (road). Doesn't matter, technically, if people are in it or not.

He should have just jovially kneecapped them with a Louisville slugger.  That would be a more measured response.  It's important he smile while doing it though - because it was just a prank.

I know. People who fark with pedestrians minding their own business *should* be shot at. Maybe it will make people stop doing it. Next arsehole driving down the road who decides to mess with a pedestrian might think twice. These two are human garbage. We can't just execute these worthless douche-bags, so it's nice to have someone willing to take the fall for doing what everyone else in the world wants to happen to them. He broke a lot of laws but the only thing he did wrong was miss.

We should be executing them.  That'll put an end to that kind of assholish behavior in a hurry.
