There are lot of folks in this thread with interesting ideas about when and where lethal force is justified.

Many of you are farking nuts.

Was this article written by the "pranksters" attorney?  How do you pour a beer on on someone from a moving vehicle?

If you throw a bottle at someone, isn't that using a missile as well?  People have died from bottle attacks.  I hope his attorney pursues the pranksters as a hate crime as well.

Clearly a little shooting back was just a harmless old man prank, these tightass kids don't understand humor, they need to realize a prank is just a prank.

Not if I'm on the jury. He didn't just brandish, he shot, he could easily have killed.  If I'm on the jury, he gets the full attempted homicide.

Cowards like that don't usually have the balls to gamble with a jury.

So he'll plead out, do 5, maybe 7 years with good behavior.  Then again, he does have low impulse control and an murderous angry streak, so the good behavior part might not be in his future.  He could be looking at 10 to 15 inside.


And if you are on the jury, what do you give the two who "spilled" a beer on the man?

It surely isn't beer... more like something that post Prohibition people that were desperate to drink ANYTHING were happy with and generations later, people actually still drink it because their parents and parents' parents drank it with no complaints, so...

That's changing, though. Thank God for microbrews.

First offense?  100 hours of picking up litter would be an appropriate punishment.   Putting idiots in jail because they disrespected others is a waste of taxpayer money.

They may really piss you off, but not in anyone's wildest dreams would that conduct qualify as a threat to society.  Intentionally spilling, dousing, or otherwise drenching someone with ale has no real potential for harm.   Yeah, the man was disrespected.  Poor baby.  Grow the fark up.

The two idiots were guilty of grade school buffoonery.   They were minor jerks.  The person they poured beer onto responded with deadly force.  He should not be walking the streets.  He is a danger to all around him.

It won't get to a jury, he'll plead out and do a bunch of time in jail.

To add insult to his jail time, the two who poured beer on him will probably get a complete walk, all because he shot at them.

They purposely slowed down their vehicle when they saw him doing yard work, and proceeded to intentionally pour beer on him. There was nothing accidental about it (as the word 'spill' implies).


Fine.  Pour, douse, whatever.

What is it with farkers and disrespect?

There are a lot of farkers who seem to believe being disrespected justifies a response of deadly force.

All I can say to them is get ready for a life behind bars.  You're going to get disrespected in life, if you respond with deadly force, you belong behind bars.

This is exactly what I find to be horrific.  The response was entirely out of proportion.  Shooting at someone because you got beer poured on you is not "understandable".

Yeup. I understand "war of escalation", but usually it's incremental: he bumps into you, you shove him, he takes a swing at you, you start brawling, someone pulls a knife....

When it goes directly from "he bumps you" to "you shot him"... yeah, someone needs a Snickers i-v.

There's a difference between understanding why someone does something, and condoning it. That's why he said "I don't condone it". Adding on, "but I understand it", doesn't mean, "but I do condone it really". It means he understands that someone was extremely pissed off and in a moment of blind rage reached for his gun. It's not nice, and no one likes it, but how can you say you don't understand why that happens? Blind rage makes people act stupid and violent. 

Nothing I said is mitigating or condoning shooting people because you're angry, in any way.

I understand all that, and your response is reasonable.  What I take exception with is this:

"Don't want to get shot at?  Don't throw shiat at people from your car. "

This clearly places blame on the target for being shot at.  The target deserved a reaction - assault charges, perhaps a beating.

Lethal force?  No.

Sure, it's out of proportion.  But hopefully those 'kids' learned a valuable lesson, without even getting hurt:  don't dick around with other people.

We're apex predators for a reason.  And the rate of gun ownership here in the U.S. is pretty farking high; piss off enough random folks, one of them WILL shoot at you, justified or not.
