This story is surprisingly amazing!  The two guys who were drinking and driving, assaulted a guy, and reckless driving apparently not charged with anything at all.  The guy shooting charged with firing a missile at them, and his excuse for shooting at them was "it was coming right for him!"

He should be up for attempted murder since he got in his car, followed these two idiots, and proceeded to confront and then shoot at them.  That's straight up attempted homicide.

I think it's because he wasn't shooting at someone; the law (using Virginia's equivalent) is firing or throwing a missile -- throwing rocks, bottles, or snowballs counts -- at a moving car on a public highway (road). Doesn't matter, technically, if people are in it or not.

Yup.  Long ago I found myself having to be a pedestrian and crossing a road commonly used for cruising.  (Note:  Don't be mislead by my name--I'm male.  That was the male spelling when I was born.)  I was hit by more than one flying object and the only way I could cross safely was to do so in view of a cop--they were totally ignoring the lights except where the cops were.  (The problem was bad enough that soon after this the city passed an anti-cruising ordinance.)

I disagree.  He said they were coming for him.  It's even possible that's true--it could be the scum drove at him to scare him off.  (That's how a lot of "unarmed" drivers get shot by the police--they're expecting the cop to get out of the way.)  On the other hand, he shouldn't have been in the situation in the first place.

Technically, the beer thing from a car is aggravated assault, too (because they were driving a car around doing it, not really the beer part).  So he is pretty much automatically going to get off on two of the four charges just by his lawyer pointing out that the other two committed an identical crime first and aren't being charged.

Discharging a gun from one vehicle into another in a populated area, though... that's a whole lot of stupid layered over two scoops of shoulda known better with an enjoy your jail time on top.  I mean, come on, even if your CCP class sucked so hard they didn't go over the basic law on that one, common sense and basic checking your field of fire, dipshiat.  I mean... come the fark on.

"Shooting to wound" and "warning shots" are things that only exist in movies and the Spycraft RPG.  In the real world if you intentionally actuate the lever bit on the bang-machine that makes the loud noises, you either have lethal intent or you're so criminally stupid that it's entirely legally responsible to treat (read: prosecute) you as if you had lethal intent.

Guns are not toys.  At their most casual they're sporting equipment, and the same assumptions apply to using them on someone as, say, swinging a baseball bat at their head.  You can't legally sell swinging a baseball bat at someone "just to scare them" either, the only way to sell that shiat is if you reveal the weapon but don't use it.

They purposely slowed down their vehicle when they saw him doing yard work, and proceeded to intentionally pour beer on him. There was nothing accidental about it (as the word 'spill' implies).

This is exactly what I find to be horrific.  The response was entirely out of proportion.  Shooting at someone because you got beer poured on you is not "understandable".


Yeup. I understand "war of escalation", but usually it's incremental: he bumps into you, you shove him, he takes a swing at you, you start brawling, someone pulls a knife....

When it goes directly from "he bumps you" to "you shot him"... yeah, someone needs a Snickers i-v.

There's a difference between understanding why someone does something, and condoning it. That's why he said "I don't condone it". Adding on, "but I understand it", doesn't mean, "but I do condone it really". It means he understands that someone was extremely pissed off and in a moment of blind rage reached for his gun. It's not nice, and no one likes it, but how can you say you don't understand why that happens? Blind rage makes people act stupid and violent. 

Nothing I said is mitigating or condoning shooting people because you're angry, in any way.

I understand all that, and your response is reasonable.  What I take exception with is this:

"Don't want to get shot at?  Don't throw shiat at people from your car. "

This clearly places blame on the target for being shot at.  The target deserved a reaction - assault charges, perhaps a beating.

Lethal force?  No.

Sure, it's out of proportion.  But hopefully those 'kids' learned a valuable lesson, without even getting hurt:  don't dick around with other people.

We're apex predators for a reason.  And the rate of gun ownership here in the U.S. is pretty farking high; piss off enough random folks, one of them WILL shoot at you, justified or not.
