zimbomba63: Maybe the zoo person was dressed like a pirate, and said to the kid, "Avast there matey, would ye like a penny?"  And the kid, then confused by the fact that the pirate seemed to know his last name went into a panic and swallowed the penny. Well, it could have happened.

I have my 4 year old grandson convinced that all you need to be a pirate is a hat and a parrot.  My step-daughter appreciates these teaching moments, that I provide.  I think.  Don't even ask about giant clams situation.

Bit'O'Gristle: /agreed. The parents didn't have a chance to get it...it was handed directly to the kid, who at 3, puts everything in their mouths. The zoo is liable.

Gonna have to object to the "put everything in their mouth" thing. We done got a three year old, and while it doesn't matter to him if food has been cooked or not, or if he found it on the ground or what, it's going in his mouth.... he wouldn't just swallow a piece of metal. Either way, suing the zoo is pretty pathetic. I say, give them ten thousand dollars, sterilize them, and give their kid up for adoption. In fact, that offer should be made permanent---anyone who wants to be irreversibly sterilized without procreating should receive ten thousand dollars---perhaps twenty---in cash. It would be the biggest budget reducing move in history....

Nana's Vibrator: Who handed the three year old the penny? If it was a zoo employee, damn right the zoo's paying the medical bill and legal fees.  If it was a parent?  Ha ha, you have to sell your stuff AND pay for your lawyers.  Idiots.

One question is if the parents saw the employee handing out coins to other patrons before them.  If you're in line and you see the employee handing coins to the kids in front of you, you may have less of a case as the zoo will suggest that you had opportunity to refuse the coin.

This. The comment at the end of the article about there being no warnings that pennies shouldn't be swallowed was stupid, but I think the complaint is valid.

But they didn't give it to the child. The park employe did.

That's right... park employee.  His title is "park employee", not "babysitter".  Why weren't the parents keeping an eye on their child?

Thanks Stonicus, saved me trouble.  Also, the kid is 3 years old.  By that age they know what is food and what isn't.

I babysit a 13mo old who knows not to put stuff in it's mouth that isn't food. If she finds something on the floor she holds it up and yells for me to take it from her.

3 is probably pushing it as far as the normal behavior of putting random things from the floor into your mouth; but being handed something and interpreting it as edible is a different story.  That zoo gonna pay.

Best case scenario? The entire family dies in a house fire, saving the zoo from having to spend so much as another penny on this stupidity. I hope the wiring in their house as bad as the wiring in their brains.

Yep. The zoo will probably lose the lawsuit on that alone, or at the very least, be found at least partially responsible.

It hasn't been established that the zoo employee handed the item directly to the child.

That's what the family is alleging in their suit.

Doesn't mean it happened that way.

Headso: NY is such a shiathole, we pay all these taxes and a 3 year old can't even get emergency medical care without running up a 50k bill? MA has lower taxes and that kid would have had MassHealth.

You can thank Romney for that.

From the NY Post article:

"So the family forked over $16 for tickets, and the promise of a free gift, for which Ethan and his 5-year-old sister Harin soon began clamoring.
"They kept saying, 'I want it!'" the mom recalled.
The gift for each family member was a pressed penny, imprinted with the words "Dinosaur Safari" and secured with plastic wrapping to a postcard advertising more than 30 similar coins for sale. An employee handed the coin directly to Ethan, according to the Bronx Supreme Court lawsuit.
"I was really disappointed at the time," said Yi, who thought the gift would be more substantial.
Next thing she knew, Ethan was choking, and the family had three pennies - not four. "

So the coin was plastic wrapped to a postcard when handed out.

I have to say, a pressed penny is NOT a good gift for a 3-year-old. They DO have sharp edges, and it's about the same as giving a 3-year-old a dull razor blade or a flattened bottle cap.

So while I would normally say it was the parents' fault, in this case, since the penny was handed to the kid, it falls on the zoo to at least pay for medical bills, and give those people a free lifetime pass to the Bronx Zoo, at the very least. They should be OFFERING to do this to avoid court.

We once thought my son swallowed a penny - my daughter (his older sister) had been given it and was going to her piggy bank when she dropped it and the toddler vacuum went into effect.  I grabbed him as he started to choke and the next thing we knew no more penny in the throat, but we were unsure if it went in or out.  We called our doctor and she told us to take him to the ER as those things can apparently be pretty toxic to young kids. A quick trip to the ER later and we discovered I had managed to dislodge it out, and fortunately we had really good insurance then, I am not sure what the bill would be these days after more than a decade of cuts and price increases.

webron: I do love how people who complain about so called frivolous law suits and complain about lack of personal responsibilities and then don't think companies should be held accountable for their actions.

that what the "personal responsibility" meme is all about, pushing responsibility for corporate negligence upon the victims.

Ethan's mother, Kelly Yi, said there was no warning about the dangers of swallowing the coins.

TheRameres: mcsiegs: 1 or 2 year old?  Ok, valid.

At 3, a child does not put everything into their mouth anymore.  At 3 (and even leading up to 3), they know those simple concepts because you taught it to them.  Most 3 year olds would feel special getting the coin and want to hold on to it...not use it as dinner.

If anything, get a second opinion from another doctor.  I am NOT a doctor, but even passing that sounds mighty painful for a 3 year old.

THIS.

My 2-almost-3 year-old knows not to put stuff like that in his mouth.  Why?  Because we taught him that only food goes into his mouth, and "food" only includes people food, not the treats that he's allowed to give our dogs.

That being said, however, I think there is some sort of gray area here for accountability between the zoo, the family, as well as the doctor that told them "give it a few days and it'll pass."

Just glad I don't have to make that call.

I want to point a finger at that hospital. I was told that pre-1991 pennies 'pass through' as they are made out of pure copper, but post-1991 pennies are copper-clad zinc, and will dissolve into a blade in stomach acid, requiring immidate surgery to prevent exactly this circumstance. How the hell do I know this when an actual surgeon does not? The hospital should also have the debt voided for causing the problem in the first place.

I can imagine, as I've seen it myself, employee goes to hand item to parent, kid starts a tantrum; then parent says give it to the kid, and boom. Kid vacuum starts up.
