She sued for being deprived of her Facebook time. Only fair that she prove it.

I was on the jury of a personal injury case where the accident victim was a high schooler who wanted extra money because his injuries prevented him from playing football his senior year. That did NOT go over well with the jury. I argued to give him the minimum the defense said he should get, but the consensus ended up being even less than THAT.

Conrod claims the injuries she sustained in that accident have left her unable to work and have compromised her recreational and social activities, including the amount of time she spends on Facebook.

Wow, that sounds perilously close to frivolous-lawsuit territory to me; but maybe Canadia's laws are looser when it comes to that sort of thing. CAN you even sue for inability to sit around wasting time as much as you used to? Because if so, I'll totally go for it the next slip&fall I sustain.

FTFA: Instead, he argued she must provide records of her Facebook usage - including log-in and log-out information - to see if it supports her claim that the accident has reduced her ability to concentrate online.

First of all, it's possible to remain logged in all the time, which I do because I'm really goddamn lazy. Secondly, wtf does ability to concentrate have to do with it? I'd think 'ability to remain seated in a computer chair' would be far more relevant. I can spend hours online just derping around (oh hi, Fark), but there are some days where my back just aches incessantly and I have to go lie down.

Well, I feel that anyone using FB in an attempted leverage point is a loser and should be dismissed.

Plaintiffs claim they're disabled because they cannot do various things.  Plaintiff posts on Facebook showing themselves doing the very things they say they cannot do.  Defence lawyers request discovery of their Facebook posts to prove that they're not as disabled as they claim.  Common practice.

I don't think the judge understands how Facebook works.

Wait, judges are going to require parties to provide evidence to back up the claims they make in court now? What is this world coming to?

Look, if you are going to sue my client and claim you can't go in Facebook...I damn well at least look to see if you are on Facebook all the time.

Sure, if she is a lurker or looking at it on her phone, there may not be a trail of activity...but if she is one of those constant updaters, likers, or IMer...well, I would be a shiatty attorney if I didn't at least look.

You have to prove it in court.

I'll have to cross examine you mercilessly.

Sounds like an unintentional benefit of the accident.

The judge is going to rule that the operator of the dump truck will have to run into everyone in the province as community service.

Ok everyone come down. Here in Canadkustan we dont usually have frivolous lawsuits. When one is tried, its shot down bad.

Few cases I know about:

TV person who her entire career was farked over by trash radio? She won, 340000 canadian dollars. She is still looking at getting payed. After lawyers? Id be surprised she gains anything.
Some guy was farked up by the police system, got in prison. 10 years. He had to settle because there isnt much of a chance for winning the lottery in the canadian court justice. He won less than 150k + his lawyers fees.

I saved the best for last.
http://en.wikipedia.org/wiki/Steven_Truscott

48 years in prison for something he didnt do. Gouv tried every trick in the books to deny payin the coverage of this really awful case. He was awarded 6.5 million, but his life is over or soon to be. His children have not told him about how much he didnt win.

Now this might sound cocky, but I know a Supreme court Judge. When we discuss, we discuss about the frivolous lawsuits. He said to me, I dont know of any Canadian Judge who would agree on compensation for any stupid amounts. Small amounts? Sure. Jackpot millions because the police made a mistake and killed someone? Nope.
