If I am using a company or office-owned computer, I'm not going to look at pron.  I can wait until I get home and its unprofessional. Based on the rather limited details, that just shows bad judgment whether you work at a school or at an office.

Putting aside the "let's think of the children", the guy probably deserves a reprimand.  Other than that, getting fired or losing a license?  That's sort of harsh.

If you want to read the full 40+ pages of the arbitration decision, here it is.  It has all the details you could want (except for the actual porn).

Condensed version:  Teacher's sister sent him inappropriate e-mails, which he viewed on school computer.  Teacher showed one to another teacher (who had asked to see it) when no kids were around. Third teacher  -- who had a grudge against e-mail recipient --  complained to administration.  Administration checked all district e-mails, and found lots of teachers got inappropriate e-mails.  Administration disciplined some, didn't discipline others.  Only one was fired; the worst punishment anyone else got was a 15 day suspension.  Union filed grievance because of disparate outcomes.  Arbitrator decided the administration went overboard firing the teacher, and the courts have backed that decision.

Funny story, this guy was only caught because he showed the porn he was viewing at the time to a female co-worker.  After she reported him, the district investigated because he was doing this on a school computer and on school property.  The district found that a number of other employees were also viewing porn on district computers.

So, did the district fire everyone they caught?  No, they didn't.  They reprimanded the rest and just fired this guy.  I guess sharing with the co-worker was the firing offense, not the use of district resources to view porn in the first place.  So he gets his job back because what he did, in the view of the arbitrator and the courts, was not substantially different from what others, who did not get fired, did.

So the lesson of this story, if you are an employer, is to fire everyone and let God sort it out.

Well, that and make it a clear requirement of employment that no employee use district resources to view porn.

The teacher should totally get his job back, provided it was adult porn, and not child porn or animal. Or gay porn. Unless it was two hot chicks going at it -- then he should TOTALLY get his job back, with back pay!
