While all efforts were made to comply with the law, Diane Ganssle said she has learned the entire episode is the result of someone complaining about deer and how their bird feeders are attracting deer.

Is bow hunting legal in the city? Invite the neighbors over for a hunting party. BYOB.

Some towns in my area hate guns and aren't too fond of hunters, but are considering a bow hunting season for deer because they are such pests.

Usually those folks are called "the HOA Board." I guess the busybodies haven't formalized everywhere.

On another note, the town should fine them retroactively. $1000 x 365 days x 25 years? The town budget is balanced, dude.

Simple.  There are more people available to work, and therefore the Job Creators (tm) should be increasing the number of people hired.  If there weren't so many unnecessarily burdensome regulations, then the Job Creators (tm) would have hired all these additional people, and then some, increasing the labor participation rate.  But because of 0bama and his Neo-Nazi Commie Liberals, the Job Creators (tm) have been barred from blessing this country with their economic magic, and instead we're now a nation of freeloaders that want more taxes and more local municipal regulations regarding bird feeders.  And we don't call our moms as often as we should.

Am I missing something?  It seems this is being handled rationally and with compassion and understanding for all parties involved.  This is how it's supposed to work, our country was built on compromise.  Black and white politics are for 3rd world countries.

The part of the Town Code they were violating by feeding birds, was it put in place before or after they started feeding the birds?

If it was in place before, then the couple would have to pay the fine or challenge the validity of the law in court (and probably be forced to pay all court costs beforehand, lest precedent be set that the poors have just as much right to challenge unjust laws as real people, but that's another discussion for another thread).

If it wasn't implemented until after they started, then the part of the US Constitution which prohibits ex post facto laws means that the couple can continue feeding the birds without paying so much as one Zimbabwean dollar in fines and anyone on the town council who doesn't like it can go lick a horse's ass.

Whats your proposal to fix the middle class?
Treat capital gains as ordinary income, raise the marginal tax rate over $1M/yr, put real limits on political contributions (and tax political religious organisations), break up anything that's "too big to fail," spend tax money on infrastructure and education and science rather than corporate welfare and the military, strengthen labor and discrimination law, destroy employers who knowingly use illegal labor, give adequate staff and better teeth to enforcement of securities and antitrust and tax regulation, end the war on drugs (and militarisation of the police), reduce military operations overseas, enhance and streamline the social safety net, improve access to family planning resources, move to single-payer healthcare, and stop electing total assholes.

Considering most Americans believe in angels and ghosts, deer being attracted to bird feed is an incredibly small stretch. Likely mistaken, but it's not inconceivable, depending on the quantity of spilled corn and other seeds.

I also can't fault the compliance person for making people comply...it's like fainting goats fainting, it's what they do!

The officials they interviewed sounded like they have common sense, so in the end it's a fairly reassuring story.

When I lived in Brisbane (opposite a police station), I had a bird bath out the front for about 5 years because our summers are brutal, and the birds get damn thirsty. We had a soliciter couple buy the house next door, and spent 6 months doing noisy/dusty renovations. Still no problem, till the day they finished and actually moved in.

I got an legal threat in my letterbox the next day about the bird bath - apparently during the heat of the day about some galahs that turned up in the heat of the day - and they considered them pests.

Meh, it was bullshiat but I had more important battles to fight at the time, so that Saturday I was out front demolishing the bird bath, which drew the coppers attention (they'd smoke out back which was directly opposite our driveway). Had a chat and finished the job.

That monday, the police put in their own birdbath, and get this - a parrot feeder. Within a week we had whole flocks of screaming sulfur crested cockatoos hanging around the police station. These are big birds and they are loud - sounding like a pterodactyl from "Lost Planet". It was piss funny.

Sometimes when they started before 6am in the morning it was mildly annoying, but both myself and my (other neighbour) both agreed it was worth it. Couple of weeks later, one of the coppers (butting out his ciggy) wryly commented they hadn't received any complaints yet.

2014-01-21 09:11:21 PM
Squirrels? Chipmunks? Big deal.

In my neck of the woods, these are also known as bear feeders.  My next door neighbor lost her bird feeder a couple times a year to local bears - and why not?  What's in them is effectively a Power Bar for a bear.  Way to train the bear to come into your yard!

I had a bird feeder for a while. I fought an ongoing battle with the squirrels. I love squirrels but they would empty the feeder in a day. I solved that eventually. Then one night I stepped onto my deck and found four giant raccoons eating seed off the ground that the birds had dropped. That plus the fact that the seed the stupid birds knocked on the ground started sprouting up made me stop feeding the birds.

When I'm old and retired and bored I'll probably take it up again.

You seem to be implying this is something new. We had a very similar situation under Reagan and Bush. As for the "libertarian" thing: you don't want government to do anything to solve the problem. Any solution to you seems like tyranny and oppression, yet you've offered no solution either. As for Jon Stewart, you understand he's a comedian, right?

They get a notification in the mail. No fine is levied until you ignore usually multiple notices. The couple in TFA was not fined.

You could try a thistle feeder and attract the finches. I think the holes are small enough the squirrels can't get to it... plus, I'm not sure they like that kind of seed.
