I can understand this 'weapon' being a threat to national security.
I can see it being against international treaties.
I cannot see it being classified as a WMD.

I don't really see how an X-Ray machine that would take three decades to kill its victims counts as a weapon of mass destruction. As an aside this man does deserve to go to jail.

However, pressure cookers and hand grenades attack indiscriminately.
This device (assuming it even exists in real life) seems more of a targeted attack.

Maybe I have the wrong concept of Mass?
