It's Orange County. All this took place behind the Orange Curtain. The beating/death was actually more surprising than the verdict, which was pretty much a foregone conclusion, mostly because cops down here in the OC don't (or hadn't been) get that out of control. However, once they were tried, no good honest OC jury was ever going to convict two fine upstanding police officers of murdering a crazy homeless bum, no matter how obvious it was that they DID, in fact, murder him.

The coroner found that the victim had "an enlarged heart" caused by his years or decades of drinking and drug use; and I guess that's all the jury needed for reasonable doubt.

These cases should *always* be subject to a change of venue.  Local prosecutors have a significant conflict of interest when it comes to securing convictions of cops serving in their jurisdictions - if they win, they lose.

I just watched the video taken from the bus depot. I have no idea how these officers weren't found guilty.

Hearing him repeatedly say sorry and pleading for his father was hard to watch.

I don't know, not having been there and not seeing all the facts, I think it's fair to say, number one, any of us would be pretty angry; number two, that the Los Angeles police acted stupidly.

You know, I'm sure there are plenty of decent cops out there who do their job well and uphold the law to the best of their ability. I've only known about 10 cops personally. One is a decent guy and 9 of them are basically bullies spoiling for a fight.

And people made fun of me for teaching my 12yo son to not trust a cops.  If stopped give them your name.  If asked anything else, ask if you are being detained.  If no simply walk away.  If yes ask for a lawyer.  Talking to the cops is never a good idea.

Murder is the unlawful killing of a human being by another human being with malice aforethought; malice defined as 1) intent to kill; 2) intent to cause bodily harm likely to result in death; 3) wanton and reckless disregard for human life; or 4) felony murder rule.

Note the "unlawful killing" part. Proving unlawful killing against a police officer in the line of duty is extremely difficult, because the standard is so much higher--assuming the cop made a lawful stop or arrest, then if he used reasonable means in effecting the arrest, then EVEN IF the subject died, the killing was not "unlawful." It's just tragic.

Now, the prosecution had a pretty good case for excessive force; and that's where the coroner's report that Kelly had an enlarged heart came in. The defense made a big deal about how it was the enlarged heart, NOT the beating, that ultimately killed him; and I guess the jury found enough reasonable doubt there to acquit the cops. I suppose a person with a healthy heart could have taken that beating and not died; since Kelly didn't die from the head trauma; but then that's why I don't get seated on juries.

The DA of Orange County personally prosecuted this case.  He had a vested interest in going as hard as he could and he did a decent job of it.  Personally, I think murder 2 was too hard to reach, but how they didn't get a manslaughter charge when one of the cops prior to the beating put on gloves and said "Look at these fists, they are going to fark you up" and the other guy repeatedly tased and used the taser to bash his head in.  All this was caught on video so there is no doubt what exactly happened.

However, the victims father did an interview and said he had been in close contact with federal authorities who were following the case and waiting to see what happened in the local prosecution.  Now that it is finished, I would expect federal charges to be filed soon for civil rights violations.  These officers may wish that they got a manslaughter conviction when all is said and done as the feds likely would have declined further participation.
