I am so glad I'm not the only one bothered by this. Anyone who charges someone with refusing to show their papers will be the first against the wall when the revolution comes (if I have anything to say about it).

So, just playing devil's advocate here, an arestee doesn't have any ID, doesn't tell the cops who they are...what's to prevent them from locking her up under 'Jane Doe' for the next year or two? I'm sure identification is for her protection as well as filing purposes.

If she identifies herself, then they won't lock her up as a Jane Doe. That is her protection. I understand that the cops needed to know who she was, but this is just such a bullshiat charge.

I have less of a problem with this, provided that they do release her (or more accurately, follow normal procedures) should she identify herself a day later. If it does take a year or two, that's on her. But my ideal would be as follows.

Take her to a judge, charge her with the real crimes, have the judge deem her a flight risk until she identifies herself, and deny bail on that. The flight risk is based on the fact that since they don't know who she is, they will not be able to find her when time comes to try her. If the crimes she is charged with (not the case here) involve only a fine and she can and wants to pay it, let her pay it and be on her way. I really don't care if the jaywalker or speeder doesn't have a permanent record.

I think it was part of the patriot act IIRC that allows people to be be detained by authoritys until they are identified. I keep warning my roomate to get her ID, hers was stolen over 3 years ago and I told her if she gets busted and they take her in to get ID I am not picking her up.

In SOME cases this is a bogus charge.

I don't mind it if it is preceded by one or more REAL charges.

If done on its own with no other charges its a "papers please citizen" thing. In this case it is not.
