If you read the fine print- which isn't in the tag line- it misses the part about potentially 8 years and 6 months of PMITA prison with UFIA.  In this case the "asinine" tag is misleading and should be "payback"

There should be no "potentially" about the sentence, though. PMITA prison is where they belong, not writing a stupid phrase 5000 times.

I can't tell by the article, is that the whole sentence or just part of the sentence. The rapist sentencing was appalling, sure, but this may have just been an additional sentence that lots of judges do.

The guy was convicted of misdemeanor assault, which carries a maximum sentence of 6 months under Montana law.  But why let facts get in the way?

which begs the question, WHY was it misdemeanor to shatter a woman's jaw?

A jury earlier this month convicted Ferguson of misdemeanor assault, but acquitted him of felony aggravated assault and felony witness tampering after he admitted in court to punching the woman.

as a victim, you can appeal the judges decision on the punishment for your attacker.....

/declare the judge was wrong, according to the law and precedence, and get a different judge to try the case

So the judge sentenced him to jail time as well as financial punishment in a matter that is appropriate for his crime.  Tag is for subby who is implying that the 5000 sentences was the only punishment.

Gah this judge is such a disgrace for us. A group tried to impeach him and were basically told "Meh, he's up for re-election in a year. Just don't vote for him." IT IS THE PRINICPLE OF THE MATTER!

Then again we also have a douchebag elected official send racist rant through his work email and they won't impeach him either. I farking hate the politics around here lately.

I don't get the outrage, he also got 6 months in jail. The jury acquitted him of felony assault and gave him misdemeanor assault instead. 6 months sounds about right for that conviction. The guy was also given 8 years for other charges the same day, which I'm sure this judge was aware of at the time of sentencing.

So once again, what's the outrage all about?

Except the 8-year sentence was from a robbery case. If i am reading the article correctly, the woman he hit was a witness to the robbery.

But, it begs an important question: He fractured the woman's face in three places, yet all he was convicted of was misdemeanor assault? How do you cave in a person's face and get away with only a misdemeanor?!

Where I am from, that is 1st-degree aggravated assault, battery, and witness tampering, all felonies.

Can we have some other examples of his rulings?  These seem cherry-picked to focus on women as victims...considering men are 77% of murder victims and more likely to be victims of violent crime.

What was the max sentence for what he was convicted of in the case with the women? Because what ever it was it seemed like it would have run concurrent with his sentence for violating his parole or probation from his previous sentence. It seems that this judge just gave him a nominal sentence because he knew he was going to get sent away for longer than he could sentence him.

The man punched the woman repeated until he caved in her face. She had to have reconstructive surgery . That is felony aggravated assault and battery, no "If"s, "And"s, or "But"s about it. The fact that he was only convicted of a misdemeanor is a severe miscarriage of justice.

He caved in a woman's face ... there is no way in Hell that brutal attack can reasonably be considered a misdemeanor. The man should be spending 20 years behind bars, not getting a small fine and community service...

I blame the jury for acquitting him the the felony charges. I blame the judge for accepting such a bullshiat verdict, and the prosecutor (if he did not do his job properly).

Not going to say it was in this case, but not so CSB:

One of my Marine friends used to live next door to a couple. Really nice 6'2" guy and his 5'4 wife. Johnny used to notice the guy had bruises, cuts, et al., some weeks a LOT of them. They also noticed his wife was really worked up some weekends. The neighbor used to make excuses constantly about what was going on, but one night the vertical blind was open in back and Johnny (and his wife) saw her smacking him with a pan while he covered.

Johnny confronted him about it, Terri confronted the wife separately, and he was just like 'oh, she's just like that, it's no big deal, she doesn't mean it' and it continued. The wife, she was just angry. They called the cops on her a couple times, and the husband was arrested once. Get that through your head, this guy was being beaten by his wife with metal objects, he had bruises (she had none), and the cops arrested him.

One day they called the cops again, but by the time they got there he was dead. The 6'2" man had a big kitchen knife in his back. She cried and cried. She told the cops how much he abused her (verbally and physically) and basically cried herself pity.

She wasn't ever charged. Despite all his bruises, cuts, scars, et al. Not even an assault charge.

Pennsylvania may have them beat though.

Teenage girl with no drivers license, driving with some other teens on a joyride.     Turns a corner waaayyy wide and runs over an man walking his dog.   Kills the man...killed the dog.  He left behind a wife and three kids.


Teen got 200 hrs community service.   Not even one day in jail.


Heckuva job there judge

Same thing happened to a friend of mine, his wife attacked him with a butcher knife and the cops were called, and he was covered in blood, and he was arrested until he could prove he had done nothing to warrant the attack, and then the judge wrote it off as a heat of the moment.

I have a coworker, female, who goes out and gets drunked up and gets in guys faces and slaps them, because she feels no one is going to hit her, one day she is gonna slap the wrong guy.
