In her defense; $3.30 an hour is a lot of money back in India. How is her house keeper supposed to live when they go back to India? It's not like the house keeper can change castes or anything...

my understanding is that diplomatic immunity can be waved by her home country, in this case India.  That is why I was somewhat suprised to see an actual arrest.  Perhaps India is not going to protect her on this, since the Indian government now has egg on its face to.  I say that because if they were going to keep protection I would never had expected to see an arrest.  Just something about how she was called home for consultations or declared persona non grata through diplomatic channels.

She will only go to trial if India allows it.  More likely, the Indian government will request she be released, she will then be escorted to a plane home, and she will be declared persona non grata and will never be allowed to return to the US.

Also, not all "diplomats" are covered under full diplomatic immunity, and there is a chance she is one of those.  I am one of those, so I have to know Poland's laws.

She is a consular officer at a consulate in NY.  She only has consular immunity--it has to be work-related.  If she were, say, a diplomat at the Indian Embassy in DC, she could not have been arrested without consent from the Indian government.

The practice of foreign diplomats bringing their domestic workers to the U.S. and not paying them correctly is extremely widespread.  Nice to see us cracking down.

I don't have a deep compassion for someone who could have left if she wanted to, but it feels like something was left out.

She probably had all of her expenses paid, including room & board, transportation and possibly a clothing allowance if she wore work clothes.

Those things have value even though they might not have to be put into a contract. The fact that there was a contract makes me believe something is missing.

Make the diplomat pay the nanny the full amount listed on the falsified paperwork and ship the diplomat back to India. That is, unless India gives the okay for prosecution.

Diplomatic immunity doesn't always mean you're off the hook. If the country you're representing cares at all about foreign relations, they might just revoke your diplomatic immunity and let the host country have its way with you. Or if they don't want you to go in the clink, they might just recall you and drop your career in the toilet.

The Googles Do Nothing: Back in India everybody has a servant and they get paid shiat.   When Indian people come here they have no idea how to wash their dishes or their clothes.  Rather than buck up and figure it out on her own she decided to find somebody from a lower caste to kindly do the needful.


My wife's friends back in the old country used to ask her why she didn't have servants to do things for her in America. She explained that she didn't want to stand over some dope and supervise to make sure some village girl did the job properly. The servants are paid shiat but they seriously are useless fellows.

Yeah true, but what would the US do if one of their senior consular officials without immunity was strip searched and arrested over a non-violent or not clearly understood offense? The stupidity of the US authorities in handling this issue has forced India's hand, they have no choice but to make it a diplomatic issue...whatever ramifications may come of this, the US has put themselves, and their own diplomats/diplomatic staff, in a very uncomfortable position.
