I remember when I was in second grade, I kissed a boy who had been bad and was standing in the corner for punishment.  I had such a crush on him.  Of course, some little biatch told on me and I got in trouble too.  My family thought it was cute.

The kid is white, so atleast for Texas - no, he wouldn't have been tried as an adult and thrown into solitary.

In fact if the kid is from a wealthy family, maybe the Texas judge would let him off with a stern lecture and allow the parents to send the kid to a nice treatment center in Southern California, in lieu of any sentence whatsoever.

When I was about that age I was playing doctor with the neighbor girl. We got caught by my parents so the punishment was just a beating. Why yes, it was a long time ago. get off my lawn!

Yeah, second-graders have genders, but don't really have the neural wiring that comprises actual biological gender identity as such, and if they even know what sex is, it's purely in the academic sense.

Sexual harassment doesn't really apply.  Harassment in general  does apply, I guess, but it's also pretty much 100% of what second-graders do to each other and the adults around them when not asleep, so that would be a weird thing to try to prosecute them for, too.

Schools have gone completely off the deep end with this kind of shiat. I think there are more than a few school admins that are hoping that somehow, someday they get to "rescue" a child. My 7-year-old son is in second grade and stupidly drew a picture of a penis and showed it to a buddy. They were snickering about it and the teacher caught them, sent it upstairs to the principal, who called in the "child advocate" who promptly called my wife and said, "I'm sorry Mrs. Jerkstore, but we have to call child protective services, we believe your son is being molested."

So this whole thing escalated to the point where we lawyered up and were expecting a knock at the door from CPS. It appears that CPS has the ability to just take the kids and sort it out later and my wife spent four or five sleepless nights worrying about them coming to take the boy.

Eventually, after about six meetings with lawyers (both ours and the school board's), teachers, administrators, principals, the superintendent of the school system, and the child advocate (who I believe is the real problem--he never backed down from his belief that my son was being molested), they decided NOT to pursue it, but only reluctantly and with the caveat that if anything else ever happens, that it will be a zero-tolerance decision to send it to the authorities.

WTF, guys? Seriously, WTF? A 7-year-old kid who thinks penises are funny? That's farking NORMAL, for Pete's sake. He doesn't know what a penis does other than help him hose down the rim of the toilet, doesn't know anything about sex, doesn't have a clue that it's a "nasty" thing. But now we had to have a talk with him and introduce all this new material to him that frankly, he just wasn't ready to deal with. We had to explain to him what inappropriate touching was and watch while at least three strangers interviewed him about someone "touching him inappropriately." WTF is a 7-year-old going to say? He wants to give you the answer you want to hear. I'm not going to fill him with hang-ups about sex being dirty and nasty, but they kind of fast-tracked that for me and now I have to explain it all to a kid who just wants to play with his Legos.

All because the school administration doesn't have the ability to make decisions. They let a book do it for them. Fark that.

I wasn't saying it was "cute", I was saying that it's a little difficult to justify going all the way to criminal charges to punish a 2nd grader for being a bully and an asshole, because 100% of 2nd graders are bullies and assholes.

That's actually a large portion of the reason we do school in groups rather than just sending every kid a book in the mail, school is about training kids out of their natural sociopathy.

Canon City schools, near Colorado Springs, backed down after an avalanche of media attention, and will no longer classify kissing a girl on the hand as sexual harassment. He was never criminally charged, but now his punishment will reflect "misconduct" instead of some kind of sexual misbehavior.

When I was younger, I really didn't understand the phrase "the road to hell is paved with good intentions". Now that I'm old and bitter, I understand it very well and your shocking and depressing story is a perfect example.

I was going to say something about this, also. I don't think a 6-year-old should be charged with sexual harassment, but he seems to feel entitled to kissing this girl when she has clearly stated she doesn't like it and doesn't want him to. He's gotten in trouble for it and still does it. Sounds like borderline sociopathy. This is actually a case where intervention by a trained professional might do some good, as opposed to JS's story.

The FARK half of me wants to laugh and agree with you. :)

The real-world half of me thinks that, when this kid gets older, the undesired affection this boy showers on girls might be a little more than a kiss on the hand.
