There was a thread about it earlier today, the gist is that the Delhi high court had struck down a law from the mid-1800's that criminalized homosexuality and set a penalty of up to ten years in prison for the offense.  While some claim that the law is rarely enforced, it has apparently been used as a way to harass the homosexual population in India.  The Supreme Court reversed that ruling, saying that it was up to the legislature to determine what should or should not be a law.

But if, as Gandhi says, the law is against the Constitution, wouldn't that be an argument for striking down that law?
