PillsHere: I don't think I'll ever understand why anyone cares if someone wants to have sex with the same gender.  It has no bearing on you or who you get to have sex with.  Your children aren't getting corrupted because some guys want to have sex with each other in the privacy of their home.  Thinking it's icky isn't a legal justification.  /I know religion and all that bs.  However, we all know that it's about thinking it's icky though, or hating yourself for having those feelings/desires yourself.  If thinking it's icky was a valid excuse for making laws against it, we should ban anyone from having sex with people like Rush Limbaugh because that's about as icky as it gets.

Homophobia has no historical precedent in India before the English occupation. Homophobia is a kind of damage that colonialism, and gloablization, do to cultures.


Well, the act in question is 150 years old and has been used very seldom, mostly against sex abusers and pedophiles; as far as I remember, it has never been used to prosecute consensual adults; I mean, how would you? Who would the complainant be? The Supreme court basically had the choice of declaring the whole article 377 unconstitutional (which they didn't want to, because it targets many other genuine criminal acts, such as pedophilia), or letting it be. The SC pointed out that they don't want to selectively enforce parts of a written law ; it is for Parliament to amend the law. Since the public prosecutor has been arguing in favour of the LGBT community, it should be easy for the govt. to bring in a law which replaces this one.

TFA is strangely written. Police don't harass the gay community because of Article 377. They harass the gay community because of social prejudice and bigotry - repealing this act is unlikely to change anything. While I am sympathetic to the local LGBT community and would not like to see them being criminalized, I can see the supreme court's perspective as well. The fact that religious institutions are against the repealing of the act is neither here nor there.

This is a good way to curb the AIDS problem that is spreading in India right now. It also helps deter people from choosing to follow that way of life and helps them choose a more normal, socially acceptible heterosexual lifestyle which will save them years of ridicule and torment and raise their quality of life trememdously.
