i think i'm missing the "pain and suffering" part. this seems to me just a way around the wrongful death claus and allows them to sue in retaliation for the incompetence of the military

Um, they would not take an entire heart for toxicology tests. They might take some tissue samples, but removing the entire heart? I don't think so. I'm not sure what to make of this, other than someone needs a disciplinary note placed in their file.

Not all that we think of as mental state originates from the brain.  There are a helluva lotta nerves in the GI tract for example.  Some research indicates that the heart is involved in a hormonal feedback loop aside from its obvious primary function.
