I felt strangely offended having to answer a survey question in order to RTFA.
To spare that feeling for others, I have copy-pasta'd

______________

UNION, Maine - A 31-year-old Waldoboro man is behind bars after police said he attempted to rob a bank but arrived just after it had closed.

Joseph M. Lewis was charged with attempted robbery and taken to the Knox County Jail in Rockland, according to a news release from the Knox County Sheriff's Office.

The sheriff's office reported that at approximately 3 p.m., Knox County deputies were dispatched to the Damariscotta Bank & Trust in Union for a suspicious male who had just approached the front door wearing a ski mask. When the man attempted to open the door he found that it was locked.

The doors get locked by bank personnel as the lobby closes at 3 p.m.

Witnesses stated the man went back to his car and left. The car was described as silver with a cardboard license plate. Knox County Sheriff's Office deputies and troopers from the Maine State Police went to the area.

Within minutes of the call, Deputy Jeremy Joslyn stopped a vehicle fitting the description near Camden National Bank at the Common in Union.

Found beside Lewis in the car was the ski mask believed to have been used, according to the sheriff's office. After talking to Lewis, police reported that he was planning to rob the bank until he found out that the doors were locked..

Chief Deputy Tim Carroll said Thursday afternoon that Lewis has no criminal record that they have found. He was being processed at the jail at 5:30 p.m. and bail had not been set.

No weapon was found in the vehicle, Carroll said

How can the police charge him with anything when

1) he never *actually* robbed the bank
2) he didn't even enter the building
3) he didn't hurt or threaten anyone

All the police have is a suspicion that he was planning to rob it- but the act was never actually committed.

Google says it was under 30 degrees in Union Maine.

Dude is a dumbass if he told the cops he was going to rob the bank.

Intent.

For an attempted crime, all that is required is all the other elements necessary except that the suspect failed to complete it due to some factor beyond his control--in this case, that he was too stupid to check when the bank closed. The inference being that if the bank closed at 5 p.m. he would have gone inside to rob it.

Not to gainsay those who answered "conspiracy" or "intent", but reading between the lines it sounds like the cops actually got him to confess (just like in all those tv cop shows).

But then we already knew this guy wasn't exactly the brightest bulb on the planet..

Ok mods, this is one of those "NO FREAKIN WAY" sites that I loathe.. not only did it require you to answer a couple questions before allowing you to READ the article.. but it also tried to track my location via a cookie that my AV seemed to deem a possible threat.. and sites like that are not cool.. now up until now I haven't had any fears on clicking links on fark as I felt they were checked for threats and such.. but this wasn't cool.

thanks for the Boobieser to post the article in question.. but shame on the mods for even greenlighting a link such as this..  it is bad enough from time to time we get links to sites that want you to PAY to read them.. but this was far more disturbing to me.

Intent.

I'm not really sure how you prove intent in this case. you can stereotype the guy and say that because he had a ski mask, he must have been a robber, but that's not really proof. As silly as this sounds, wearing a ski mask doesn't automatically make you a bank robber. What if he had actually just been skiing and had a reason to have a ski mask? He didn't have a weapon or probably even a note.

I'm thinking the cops probably got a confession out of him, that's the only way I see this working.
