How fast can the backhoe go? Under Massachusetts law construction vehicles incapable of exceeding 12 mph are not legally "motor vehicles."

Specifically, the definition of motor vehicle excludes "vehicles used for other purposes than the transportation of property and incapable of being driven at a speed exceeding twelve miles per hour and which are used exclusively for the building, repair and maintenance of highways or designed especially for use elsewhere than on the travelled part of ways".

Then the prosecutor argues the snowplow loaded onto the bucket counted as "transportation of property" and the lawyers go 15 rounds and come out with a plea bargain.

Impeding normal flow of traffic? Blocking the progress of emergency vehicles? I can think of lots of ways you could nail this guy to the wall and make him beg for DUI.

Amatuer?. My hometown, the guy who owned the junkyard had a DUI in a car, truck, ATV, and a farking lawnmower. He had a lot more but the cops just brushed a bunch off because.....well it was a town of 1600, that's why. Just Jack being Jack.

Most backhoes can go faster than 12 mph.

For example, this one goes 20.4.

I had a conversation with a horse trainer about drunks and horses. Horses are okay if the rider is blacked out, but tipsy riders have a history of misguiding horses into injury, and one of her charges would attack anyone with alcohol on their breath.
