That shiatbag should be facing years if not decades of ass rape in prison for that stunt.

Maybe Clint should pay him a visit....make his day

It was absolutely a dick move, but he did retract it and pay them some money. Not enough, IMO, but they took it. Not sure how long this can be repeated in court after court (as in, I have no idea of the legalities involved, and I guess a court will tell us).

No - don't sell yourself short.  That was good!

Actually, they already settled with him in the amount of $10K. I can't support them going back to him every year for a chunk of money.

Regardless of what you feel about the Martin/Zimmerman incident, What Spike Lee did was just spiteful and evil. He should face criminal liability.

Glad to see at least two people read the article. And subby, don't ever make me side with spike lee ever again.

Yeah, they were foolish to settle quickly and for so little.  I'd wager they don't (or at least didn't previously) understand "how the internet works" with regard to outrage.  And, presumably, they also didn't consult a lawyer.  But they *did* settle, so I'm not sure they'll get much traction on this new suit.

Lee's lawyer probably pulled up the tax records on the McClains' house, estimated their net worth, and spit-balled a figure that would momentarily "wow" them.  I'm surprised he had the nerve to go with a figure so low, but it apparently worked so I guess he knows his business.  Although I *am* surprised that it didn't come with a non-disclosure clause attached, so it wasn't a "perfect" deal.

It was a horrendous dick move by Lee and he's extraordinarily lucky with regards to how it played out.  He benefited from his own stupidity when he sent out the wrong address which, fortunately for all involved, the national media picked up on quickly.  But for that happy accident, something far more tragic might have occurred... which, sickeningly, could have been the intent.

I think it was pretty obviously the intent. Why else tell your fans where the supposed white devil lives?

Guess the blue-hairs ought not have reached a settlement with Spike. Sure, Spike acted like a douchenozzle for tweeting their address but compensation was accepted. Better call, Saul.

The 10,000 were for tweeting out their address.

The 15,000 are for the death threats they've been receiving after Zimmerman was acquitted.

Either way, even if it was Zimmerman's real address, Spike Lee should be in jail because there's no other reason for posting the address but to want someone to harm Zimmerman.

In other words, Spike Lee was such a cowardly shiatbag that instead of harming Zimmerman himself, he tried to set it up so OTHER PEOPLE harmed Zimmerman for him without being directly linked.

The irony of it all is that the person harming Zimmerman would have been black and then faced justice and go to jail, then Spike Lee would have indirectly but intentionally sent a black person to jail for doing what he didn't have the balls to do himself. In other words, Spike Lee is as racist towards blacks as white racist people XD

I hate that I'm siding with Spike Lee.  They reached an agreed upon price for the indiscretion.  The fact that they low-balled themselves isn't Spike's fault.  With that said, f*ck you Spike Lee.  I'm so tired of your militant, Louis Farrakahn-style white devil bullsh*t.  You perpetuate racism just as much as the KKK.

Both parties are losers in this game, just for differing reasons.

"Elderly couple Elaine and David McClain are currently suing the Do The Right Thing director for a paltry $15,000 in damages, due to Lee tweeting out their address as George Zimmerman's, back in 2012. Lee apologized to the couple immediately after his misguided tweet and paid them a $10,000 settlement, but a year and a half later, the hate mail and death threats continue to pour in for the McClain's, as people are still retweeting Lee's comments."

According to the papers filed in the current lawsuit, they did consult with a lawyer, and it was their lawyer who reached out to Lee regarding a settlement.  Now, they have a new lawyer who is seeking more money for them.

The original settlement released Lee from all claims arising out of the tweet.

A tumor is an unforeseen circumstance.  A Twitter retweet is forseeable and expected.  How much do you want to spend to see if you can convince a jury that it is not?  These new lawyers are just looking for a quick settlement.  Now that Spike Lee's lawyers are going to fight it, they will back down.

Be nice if Spike Lee maybe tweeted to leave them alone, facebook it, etc. and maybe offer to pay to upgrade the security on their home, etc.

Bet you a cookie thats not the way that any court is going to see it. To your own example: If I beat you, you take me to court for assault and damages rendered then and for the forseeible future.

He tweeted totally inappropriate things. They biatched. His lawyers said, Rectify this Spike. He did, and gave them 10K. They said thanks and we drop charges related to said incident. Oops.

They accepted cash for damages. Current and future with no additional clause for paying if anything else was done. Probably via contract. They got Low balled (badly) and I feel for them, but uh, nope.

/ I was told there would be punch and pie..?

Lee's response to the couple's lawsuit? A motion for dismissal, on grounds that the continued harassment was "foreseeable."

Well, of course it was "Foreseeable", as in he should have foreseen the consequences of HIS actions.

Except that they AGREED to release him from all claims arising out of his tweet.  They knew, or should have known, that the harassment (by third-parties, not Lee) may continue after the settlement--why would the settlement affect actions taken by third parties?  They (and their lawyer) should have considered that before they agreed to a settlement.  You don't get another bite at the apple because you find a new lawyer who thinks you should have gotten more the first time.

Meh. Spike Lee is a prick. I definitely wouldn't have stopped at $10 Grand. Hell, if they were smart, they would have structured the settlement so that he had to pay to completely relocate them, and handle forwarding service for a year or so, so that only people who should have their new address and phone number actually had it. Instead, he got off with what amounts to getting caught farting in the elevator. I just can't be mad at these people.

couple should record each and every threat. get a third party to examine and verify each and every legitimate threat.

Or, ya know... Call up a lawyer and come to grips with the fact they are f*cked since they accepted and spent his settlement money that probably indemnifies Spike Lee from any repercussions, known or unknown.

Again, sucks to be them, but MAN they could have had so much more. Hindsight and all that.

The system didn't even prosecute the NBPP for printing out flyers offering $10,000 for Zimmerman "dead or alive". Spike Lee had nothing to worry about.
