ltdanman44: entrapment

Entrapment is if the police induce you to commit a crime you otherwise wouldn't have.  Since, at no point did an officer suggest or try to tell this person they should shoot at this deer, its not entrapment.

Also, why isn't subby getting ripped a new one over claiming that looks like an elk?

I have a serious problem with calling this "poaching", all the other BS charges aside...

This doesn't involve taking elephants or rhinos or tigers or anything endangered and having a high resale value.  No real market exists for deer parts or meat.  Yes, you can buy deer meat in some specialty shops, but they have a looooong audit trail to prove the meat came from farmed rather than hunted deer, and wouldn't buy from some random schmuck dragging a carcass in off-season.

Which means anyone "poaching" deer has done so to feed himself and his family.  And again - Not talking about an endangered animal here, talking about a nuisance animal that causes hundreds of fatal car accidents each year we have so many of the damned things.

I have no problem with killing for food.  Hunting for the purpose of self preservation should count as a basic human right, not a string of miscellaneous crimes-by-technicality.

I saw three whitetail deer this afternoon outside my house.  They all looked like this so-called "deer" and not at all like elk.

Has subby ever seen an elk? I think not...

J. Frank Parnell: CreamFilling: Why isn't "I didn't shoot any deer" a legitimate defense?

Because admitting to randomly shooting a rifle for no reason might be even worse.

And because attempting to commit a crime is still a crime, and that still doesn't help his "shooting from a roadway" charge. Also, to use the "I didn't shoot any deer" defense they usually simply call that a plea of "not guilty", unless he uses the "but it was a robot deer" defense, in which case he'd have to cop to the "shooting from a roadway" charge.

Also, why this is even news (not on Fark; in general) is newsworthy itself; these things have been in use for (probably significantly) well over a decade.

Not sure why this is a story.  Deer decoys have been used by state DNR officers for decades.  It's been at least 15 years since they switched to the animatronic ones.  It's an anti-poaching thing.

Anyone who looked at that and thought it was a real deer is too blind to own firearms.
