Not sure why this is a story.  Deer decoys have been used by state DNR officers for decades.  It's been at least 15 years since they switched to the animatronic ones.  It's an anti-poaching thing.

Also, to use the "I didn't shoot any deer" defense they usually simply call that a plea of "not guilty", unless he uses the "but it was a robot deer" defense, in which case he'd have to cop to the "shooting from a roadway" charge.

Also, why this is even news (not on Fark; in general) is newsworthy itself; these things have been in use for (probably significantly) well over a decade.

The article says "morning". Probably early morning (dark, limited vision). The eyes (iirc) are luminescent or lights or something, simulating eye shine or some shiat.

And, let's face it: given the articles that routinely show up on Fark, hunters'll shoot at farking anything. For instance: link.

They charged him with that too. One count of illegal discharge, two counts related to illegally taking a deer. That's bullshiat, unless those statutes also include attempting to do those things, like to cover if you shoot and miss. Otherwise, I think that should be an ironclad defense. Maybe they should tack on a charge of destroying government properly though.

Love it that the comments are centered on elk vs deer as if it should be common knowledge and you're an idiot if you don't know.  I could tell you the difference between a seal and a sea lion when I was 10 but I wouldn't expect anyone inland to know.

I took a wildlife law enforcement class back in college.  One of the stories the instructor told of when he was working as a game warden was about one of these things.  He and a partner set up a robodeer in a field, while they sat in a blind just inside the tree line.  They busted a few people for shooting at it.  Then, shortly before evening fell, this old Cutlass Ceirra rolled to a stop at the side of the road.  A little old lady climbed out and started tottering across the field towards the robodeer.

"Shoo!  Shoo!  Get outta here!  They're gonna shoot you!"

Finally, as she struggling closer, and they're tying to hold in their laughter, he had to stand up and lean out of the blind.  "Ma'am!  It's fake.  We're trying to catch poachers."

But attempting to commit a crime isn't that crime itself. It's attempted murder instead of murder. Breaking and entering instead of burglary. He's already screwed on the firing from a roadway charge. Hunting out of season probably doesn't actually require that you kill anything, just that you intended to. But as his internet lawyer, I refuse to give into the third charge without a fight.

I saw three whitetail deer this afternoon outside my house.  They all looked like this so-called "deer" and not at all like elk.

Has subby ever seen an elk? I think not...

It's clearly not a robotic deer. I'm guessing its either a moose or a caribou. Possibly an an antelope, but they're not native to Florida.

Did they change the picture at some point? because all the folks in the article's comments saying its an elk in the picture seem entirely ignorant of what an elk actually looks like..
pretty hard to mistake an elk for a deer and vise versa..
As for it being entrapment? nope, setting up some bait is not entrapment.. now if a cop had handed him a rifle and said.. take a shot at that deer. Then it might be entrapment. This is more like those bait cars that the cops put on the street with the doors unlocked.. the thief that gets in the car and tries to drive away is not being entrapped. free will and what not, no one made the guy stop and take the shot. He could very easily have just kept on going down the road.
