The San Joaquin County District Attorney Robert Himelblau said late Wednesday afternoon that unless additional evidence is presented, they will not be filing criminal charges against Magana-Farias and Victor Farias.


One of these sentences is not like the other one.

I think this is newspaper-speak for "she was lying." But with "reporting" the way it is now, who can tell?

The fact that they are not facing charges tends to indicate that the ex-wife is lying. On the other hand if evey ex that needed it were to be given an exorcism there would not be enough priests in the entire world to preform the task.

Wouldn't she have to press charges? Perhaps since one of them was her son she declined to (and I doubt she could press charges on one and not the other).

Kidnapping is a federal offense. Even if the ex-wife did not want to press charges the feds would not be so forgiving unless of course there really wasn't a kidnapping.

I can't believe they had to drive for an hour and a half to get to the exorcism. Back in my day, they would come to your house.

Yes, and? No charges were filed, despite what looked like a felony. The DA must have thought that she was lying, or at least, there was something very wrong with her story. Not even an "investigation is ongoing." Nope, they're done. She made it up.

Okay, you got my curiosity up.  Would the feds really get involved if the abduction stay in one state or would they only get involved when the abducted is taken across states lines?  I wonder if that would be the case because lets say I steal a car and never take it out of MI, I only have to worry about state and local police.  However, if I take the car out of state, it becomes a federal crime.  Could that be the case with taking people?

That's a good point, had it been only the ex, charges would likely have been pressed against him.

Kidnapping is federal even if you do not cross state lines. Look at the Smart case in Utah. She never left the state and her kidnapper got slapped with federal kidnapping charges. I know there were a slew of other charges but the federal penalties for kidnapping put him away for a long time just by themselves.

Either the DA genuinely believed there wasn't enough evidence, or the DA is a backwater moronic baptist that believes in exorcisms and is incapable of understanding how forcing someone into one could be considered a crime.

Or possibly there were 3 adults agreeing that she was there willingly and only one (her, but only her) saying she wasn't. If there weren't injuries and no other evidence it might be a she said, they said case.
