I can't remember (and way to lazy) where it happened, but I think it was in the southwest area when they were going in to the bars and making them blow in the tube.  If they were drunk they were arrested for public intoxication.


/Thank god the laptops don't have that where you can only post when sober.  Fark would be very very quiet sometimes.

Virginia and Texas, based on old Fark stories. The aftermath of the Texas enforcement effort was "die in a fire."

The problem can arise when the legislature sets a .08% BAC limit for driving by redefining what intoxicated means for all criminal law. If intoxicated means .08% and it's illegal to be intoxicated in public, a lot of people in bars are criminals. Other states say it's illegal to drive drunk OR with .08% BAC, and miss out on that particular unintended consequence.

It happens, and probably not just in F-L-A.  A few years ago, I went to a neighborhood sports bar for a brew, burger and ball game.  There was an 'elderly' woman there who called the cops.  When the cops arrived, they told us to STFU.

Or GTFO, at least until she after she left.  We did, until she finally split.  The second half of the game was great.

In Arkansas where I live, it is legal for the customers to be drunk inside the bar because our bars have to operate as "private clubs", so as long as they're inside, they're "private" enough to be free to be drunk.  Restaurants that serve alcohol with a restaurant license as opposed to a "private club" bar license aren't protected by that, so you can't legally get drunk at one of those.  No, no one enforces it, but technically, if you have a buzz while you watch the game at Buffalo Wild Wings, you could get busted here.  And at any alcohol serving establishment, even "private clubs" the bar tender could be arrested for allowing you become intoxicated.  If you're drunk in the bar, the bar tender could go to jail for letting you get that way.  They get charged with "over-serving" and that happens somewhat frequently, like pretty much any time the police get called out for a noise disturbance or a bar fight or a complaint of any sort at a bar that's had complaints before.

That's also why AR bars are often such sticklers about not letting people in who have "pre-gamed".  If the cops show up and you're intoxicated inside their bar, there's no way for the bar tender to prove that he wasn't responsible for that, that you'd already been drinking when you got there.  So here,  you're totally likely to get turned away at the door if you show up already buzzed.

It really depends WHERE you are, I live in central florida for example and in some bars we have a BAC machine. You put your dollar in and it tells your BAC - the idea to see which of your group has the highest alcohol in their system vs the "daily average".
No you will not be arrested for using the machine, only ones who get arrested for public intoxication are idiots who make being drunk far to obvious in public. Whether they are YELLING into a cellphone, or staggering all over the place and crashing into things, the most obvious reason is for being aggressive for no reason other then being drunk.

Hell I once was sitting in the back of my pickup so drunk I could barely move, pair of cops showed up asking me how I was doing that night, I told them F'ing awesome. He mentioned "you look a little drunk why not go home" I told him I would "shaking my keys" if only my cab would show up quicker I would go home. These guys would arrest me for terrorism charges if they could somehow make it stick, being drunk really doesn't bring any cash in unless they can get you to act completely stupid as most would.

I've been drunk in a dry county and the cops won't do anything as long as you dont openly show you have any "Booze" or act like a retard.

The TABC did this a few years ago by going to hotel bars in Dallas and citing people (a lot of whom weren't even drunk) with public intoxication.
