Anastacya: I remember reading about this; my favorite part was how the company who sold the land to the school board explicitly stated on the sale papers (after repeatedly telling them NO and that they didn't want to sell the land because they knew about the pollution; the city threatened to use Eminent Domain to take the land if they didn't sell) that they told the city 1) about the pollution, 2) they cannot be held responsible because they repeatedly warned the city about the ground contamination), and 3) we're charging $1 because you know there is a lot of bad stuff in the land.And, of course, they built a school on top of it. And then they sued the company who sold them the land./the stupid...

Fukushima?I see your point, but there's the small matter of everyone claiming that the site had been cleaned up (it was in fact a superfund site). Occidential Petroleum and the state government both signed off on the site and said it was clean.You seriously think that the home purchase contract didn't mention a word about this, erm, issue?In most places real estate transactions require complete disclosure and I'm assuming the vendor (Occidental Petroleum) disclosed the history, and even if they didn't Love Canal is a fairly well known story. Still, Occidental did assure purchasers that complete remediation had taken place (I believe the remediation was a condition of permitting the homes to be sold in the first place - these homes were some of the ones abandoned in the late 70's).This is the sames as any brownfield development (just on a much larger scale): If you conduct site remediation and guarantee it to be free of known hazards you are liable if it's not. Assuming there is lingering chemical contamination (and the article presented no proof of such other than anecdotes) and that such contamination comes from the Love Canal (I suppose it's possible there are additional dump sites in the area unrelated to Hooker Chemical's disposal in the 40's), Occidental could be held liable.
