If you changed plans to one created after 2010 that doesn't qualify, or your insurance company changed the plan significantly after 2010 so that it no longer qualifies, that's not the government's fault.

Devil's Advocate: How long does a plan usually last on the individual market? The individual market has so much churn that a plan that has existed for 3 years is rare in and of itself.

Of course, that then bolsters the point that cancelling of plans was already the norm for the types of plans most people are getting cancellation letters for...

Grungehamster: How long does a plan usually last on the individual market?


The basic structures of plans can actually last for a very long time. I've had the same basic health insurance plan at work for almost six years now. The law doesn't prevent them from changing at all, they just can't change substantially. For all intents and purpose, you can't just change it to a whole new plan, call it the same thing and claim a grandfathered status.

The best part is, some of the key things the grandfathered plans don't have to guarantee are some of the most popular provisions of the PPACA:

- No guarantee to choice of your primary physician and no guaranteed emergency care access (e.g. you can have a plan that requires you to contact your primary physician first if at all possible)
- pre-existing conditions can be used against you
- yearly limits on payouts are allowed

They also aren't subject to rate review so you have no protection at all from "unreasonable" rate increases unless your state mandates it and offeres an empowered review board (which most don't).

So, basically, that "red Solo cup" some people supposedly want is apparently full of hemlock.
