Are we not supposed to arrest people who steal now? If you steal from the government, they issue a warrant for you, and the next time you have police contact they arrest you.  I'm trying to figure out exactly what I'm supposed to get outraged about here.

I'M OKAY WITH THIS. What a farking loser - while of course now it's outdated and practically worthless, that farking loser had it for three years, and pretty much just said "Well, fark all dese other peeps yo, dis shiat mine now." I also wish libraries would check each item out when it comes back and force assholes to pay when they return scratched up DVD's and books where they write god shiat in the margins.

If you get arrested on a warrant you don't go to prison, you go to jail.  You're held there until you have an appearance before a judge, who probably sets a court date for you to appear at and then releases you.

In most jurisdictions you can only get a garnishment without first getting a court judgment for certain specific debts prescribed by statute.  Typically these are things like unpaid income taxes; court ordered child support; child support arrears, and; defaulted student loans (that's the list for California).

If you want to get a garnishment for something other than one of those things, you need to get a judgment from a court first.  Just the fact that you're a government agency and claim they owe you money isn't enough.  To get a judgment someone (probably a City or County Attorney) would need to file a suit in an appropriate court and actually follow through with the suit until the court issues a judgment.  After that, you can go back to the court and get a garnishment order.

But that's a lot of work to go through for a tiny balance.  What they're doing now is a lot easier and less costly.

I have no problem with this either, there has to be some kind of recourse when they try to contact people and get nowhere. The guy had the book for 3 damn years for fark sake.

Theft is also about intent.  "Forgetting to return" is a whole lot different than "taking without intent to pay".

It's stupid because it is giving someone a criminal record over absentmindedness and also something a large portion of the society does at one time or another.

A much more sensible remedy is for them to setup a system where they can send you to collections if you don't return the book within x time.

He was using hyperbole.  It's not actually a felony.  It's a civil offense:

§ 323.072.  Abuse of County Library Services 

   (a) The commissioners court by order may adopt reasonable regulations that prohibit a person from abusing library services by intentionally failing to pay a library fine or return library property.

(b) A person who violates a regulation adopted by the county under this section is liable to the county for a civil penalty of not more than $ 100 for each violation. A county may bring suit in a district or county court to recover a civil penalty authorized by this subsection.

It's not giving someone a criminal record.  It's a civil matter (like a parking ticket) not a felony or a misdemeanor.  See above.
