Honestly, a trade dress claim by itself, without a copyright infringement claim to go along with it, is pretty weak. I would almost wager money that Jack Daniels knows they would never win at trial, but they're banking on the hope that Sutton is too small and young an operation to be able to afford hundreds of thousands of dollars in legal fees and costs, and will just settle for changing its packaging to make the case go away.

/Prefer Crown or Beam/Beam Black best, but would even happily take Crow or Seagrams over Jack (Actually, just do not drink Jack) or if my mother is coming by for a holiday visit and you can't exactly strut around with a lowball.. Kahlua or Baileys in my coffee.

Think Bourbon, but without the corn sweetness and spicier. Rye is great in winter, and is really what recipes like the Manhattan and Old Fashioned were intended for.

It's always worth keeping a bottle of Old Overholt on the shelf, IMO.

It seems to be similar.  From what I gather, you use a predominantly corn-based mash which is then distilled to around 160 proof.  It is then aged in either used or uncharred barrels for 6-12 months.  I haven't found if there is a preference in using pot stills or reflux stills, though.

There are lots of small batch ryes out there - it's displaced bourbon as my brown drink of choice.  Along with the Bulleit, try High West Double Rye or Jefferson Rye ...

George Dickel rye is pretty great, I think you'd be hard pressed to beat it at its price - around $25 a bottle in these parts (Jefferson is $40). It's LDI whiskey, like High West (which we don't get here).

Other bourbon rules include: mash bill of >50% corn, and aged in new white oak barrels (none of this "port" or "sherry" barrel aging you see with scotch) for a minimum of two years. Jack Daniels is not a bourbon because they filter the product through maple charcoal, which violates the regulation.

His wife cut a deal with Hank "Ow, My Face"  Wms. Jr to license his name. Or, for that matter, when the Scotch Whisky Association sued Nova Scotia's Glenora distillery over Glen Breton using "Glen" in its name. Never mind that it clearly identified itself as a Canadian whisky. Fortunately, the SWA lost its appeal.

I know that actual trademarks have to be defended, but the Jack bottle and the Popcorn Sutton's bottle don't look even vaguely similar. I think the big guys are looking at what happened to the beer business (where craft products are on the rise and macrobrews waning) and freaking out, and will come up with any bullshiat excuse to smash upstarts.

On the other hand, in the whiskey business, it's hard to tell who's real and who's the faker. There are lots of ryes out there that all come from MGP Ingredients in Lawrenceburg, Indiana. Some of it is sold under major brands (Bulleit, Dickel), and others are smaller players (Templeton, etc.). It's all good whiskey, but it isn't coming from who you think it is. The only differences are where and how long it's aged (and with Dickel, the maple charcoal filtering).

Of course, a craft distiller has to wait several years before its own product is ready to be bottled - and unless you can get minibottles or find a bar serving it, you have to gamble whether a fifth of unknown hooch is worth its price.

There are a lot of square bottles. They don't roll, and that reduces breakage. There are a lot of black labels. There need to be more similarities than that to cause confusion in the marketplace. The squiggly design over the writing seems vaguely similar, but the font does not. I don't think Jack Daniel's has a case.

I think the real issue here is Jack Daniel's competing product, Unage Rye, bottles look less like their own product than Sutton's new bottles.

Of course, Jack Daniel's poor bottling decisions are not their competitors fault.  Then again, maybe I am willing to give consumers of alcoholic beverages more credit in their ability to read the label when making their beverage selections.  For example, in the wine industry the overwhelming majority of the bottles look very similar, as do many labels.

I got introduced to a bourbon I'd never tried earlier this year and liked it quite a bit. Heaven Hill. I liked it even more when I went to buy a bottle for myself and discovered it's damn affordable. Now I can save my cash for the expensive stuff I like, like Redbreast and Middleton.

Speaking of bourbon, I had some Knob Creek Single Barrel Reserve 9 Year last night. It's 120 proof. Delicious but, oddly enough, I found it dried my mouth out like crazy.

Nope, filtering is permitted, and quite a few whiskeys that call themselves bourbon do the same thing. It's bourbon. In fact, in NAFTA and various other trade deals, we spell out "Tennessee Whiskey" as a protected term. You know how we define it? Straight bourbon made in Tennessee.

When I was a freshman at Georgia Tech, my next-door-neighbor came into my room just after Christmas break with a bottle of Old Grand-Dad in a cardboard box.

"Look what I have," he says and swings the box up, imparting enough force on the box that the bottom split open, dropping the bottle from head-height onto the linoleum floor.  Glass and booze went everywhere.

That stuff took the finish off the flooring and I had to keep my windows open for days (in January) until everything aired out.  It took a long time for that smell to get out of everything and I felt like drinking liquor again.

I had a security "indecent" at my work recently, and the company we hired (they are out of Denver) for the response came in and gave me a response kit which included a fifth of Stranahans, along with some pain killers, tums, coffee, and some other goodies which are necessary when you have an outbreak of malware on your network. That there is some damn good whiskey. It's a shame that they don't sell it outside of Colorado.

I didn't like the rye, but their bourbon is my shelf brand.  I found the rye to have an unpleasant burn, but that is just me.  So many amazing things to try, only so much time.

Thank you, as do you now!  I'm also not in Colorado, but I travel there semi-often and buy a few bottles.  They have a special whiskey they call Snowflake about twice a year that I want to get my hands on, but it's basically impossible to get unless you go to the distillery the morning of the announcement.  It's usually 6 or less barrels worth of the best flavored whiskey they have at the time they decide to do it.
