I have issues with the state!

They claim they want to promote "the optimal mode of child rearing", but I don't believe that the nuclear family is it.  The nuclear family teaches children to live by base tribalism at all levels, fostering a strong focus on greed and self-satisfaction.  It teaches children to vie for interest from their parents and to pit their authority figures against each other, as well as to submit to authority without questioning.

The optimal mode of child rearing would be an adult gender separation by which the men and women are separated.  The men would provision for the women, and the women would collaboratively raise children.  Adult males would likely still chose a singular mate and represent responsible fathership; but the actual raising of children would be such that mothers are considered to be a group, and children are considered to be raised in community rather than in family.

I request as such that the State of Utah submit research into the effectiveness of the Nuclear Family model of child rearing in comparison with other modes of child rearing.

Because we all know that it's impossible for women within a group to be pitted against each other and men have nothing of value to offer in raising children beyond sperm and resources.

Meh, whatever.  The state's attorney is REQUIRED to mount a defense of the state constitution in the event of a lawsuit, so he/she came up with whatever lame arguments he/she could.  Big deal.  I assume their only other option was to quit...and this lawsuit is hardly something to lose your job over.

When the voters want to repeal it, they will, until then...they won't.  Marriage is still a right reserved to the states...and until the Supremes decide to do a land-grab on that right, it will remain such.  biatching at the AG won't accomplish anything.

GoodOmens: Wait - so they can also deny older people remarrying or what about couples who either don't intend or are not capable of having kids?

Do you now have to do a sperm / fertility test to get married?

In Utah they're most satisfied if the teen girl is pregnant at the wedding.  Proof the kids are getting an early start on a big brood.

Cagey B: This is, of course, why old people and those who are sterile can't get married in Utah.

Came in to say this. Glad someone covered it right away.

It makes me crazy when I hear debates on TV/Radio and people bring up the "Oh, gay people can have and raise children, too." when the best way to shut the conservatives up is to say, "Does that mean old widows can't remarry?"

The "promoting responsible child rearing" argument, as stupid as it is, is also the best one they have left. If you're arguing in favor of keeping a marriage ban, that's pretty much the only non-religious argument you have. It's why SCOTUS should rule that marriage bans fail even rational basis since the best argument is still Irrational. Of course, it's still going to be a 5-4 decision with an epic Scalia rant no matter how irrational the arguments are.

If you do the old "necessary for procreation" argument isn't the judge supposed to immediately ask if you deny straight, infertile couples marriage licenses? And then laugh you out of court? I thought that's about where we were at as a society by now.

The "responsible procreation" argument comes from existing case law.  Several courts have accepted that theory as a rational basis for retaining the traditional definition of marriage.

2013-10-14 05:26:28 PM

Mike Chewbacca: It's kinda difficult for a gay couple to accidentally get pregnant.

Yes, and this was the rationale underlying the New York Court of Appeals (their "supreme" court) 4-2 holding barring gay people from marriage.

Gay couples can have children, the majority conceded, but it would be perfectly rational for the legislature to conclude that since they cannot "become parents as the result of accident or impulse...the Legislature could find that unstable relationships between people of the opposite sex present a greater danger that children will be born into or grow up in unstable homes than is the case with same-sex couples, and thus that promoting stability in opposite-sex relationships will help children more."

Yes, the court actually concluded, it's somehow rational to bar gay people from their fundamental right to marry because they're not irresponsible parents, while rewarding straight people with the manifold and manifest benefits of marriage because they're irresponsible, impulsive, dangerous and unstable parents.

2013-10-14 05:34:06 PM

Josu: You don't need to be straight, you just need to marry someone of the opposite sex.   Totally non-discriminatory.

Yes, and no doubt the good folks of Utah would also regard a law barring people from marrying Mormons similarly non-discriminatory because it would prevent both Mormons and non-Mormons alike from marrying Mormons.

Marriage is already restricted to require that a spouse is:
* Human
* Alive
* Old enough
* Not a sibling or other close relative
* Not already married
In other words, there are restrictions connected to bestiality, necrophilia, pedophilia, incest, polygamy, and so forth. Now we get to the last one,
* Of the opposite sex
And everyone goes nuts. So ask yourself, do you really believe in "marriage equality"? If so, the only way to achieve it is to oppose legal recognition of same-sex marriage, as well as opposite-sex marriage and all marriage, so that marriage is like baptism, something personal and religious that the law is simply not involved in, much less a privilege that the state "licenses".

2013-10-14 09:33:58 PM
I am really glad my Mom and her husband eloped to Nevada to get married rather than Utah. While he was divorced and she widowed, I think that their ages at the time (late 60s) would not have been ideal for "responsible procreation". In fact, if by some miracle my mother became pregnant in her 60s or 70s, that would not have been very responsible at all!

Amendment 3 does not discriminate because "neither a black person nor a white person may marry a person of the other race."

Oh, wait, that wasn't it.
