Couple things:

1) In California (IIRC), doctor-patient confidentiality passes to the executor of the estate upon the death of the patient, and the executor has the same right to waive confidentiality as the patient had while alive. And the executor may have done so.

2) Not sure how HIPAA applies (if at all) to disclosures involving deceased patients, especially to patients who were deceased before the law went into effect.

There must be some kind of statute of limitations grandfathered in there.  I can't imagine the surgical notes on a woman who has been dead for 50 years is in violation of her privacy.

This guy is a plastic surgeon.  I think it's safe to assume that he paid a very good lawyer a lot of money to determine if he can be sued over this.

Marilyn was a good actress. But don't overstate it, she was just good and her looks helped her. How many film roles did she have that would have been offered to a less glamorous actress?
