He makes no mention whether lesbian employees were also targeted for termination.
     Nonprofit equality rights watchdog Human Rights Campaign gives Home Depot 75 out of 100 on its 2013 Corporate Equality Index. The retailer earned points for providing health and soft benefits to domestic partners, its diversity training program, LGBT-oriented philanthropy and having a diversity working group that includes LGBT issues.

     Housh admits in his complaint that Home Depot placed him on a performance improvement plan, or PIP, in 2008 - three years before the allegedly false write-ups and his termination. However, he says that this was done to get him to quit.

I won't say my spidey-sense is tingling, but I would be curious why the harassment started three years before they found out he was gay.

Sounds like he was shiatty at his job, home depot got rid of older people during the down period and now he's trying to get cash.

If you're on a pip then that means a lot, its basically advancement suicide, everyone knows that and pretty much means he's a shiatty worker.

The Lowe's in my area had a transgendered employee that they were very good to. The let him use the women's bathroom, since he identified as a woman.

So why is there a bunch of web sites pushing  to boycott Home Depot because their LGBT support?  They're like the opposite of chick fil a. More like he's a 25 year asst. Mgr.  My wife's been in retail for 20 years and you either move up, down or out. I've seen the same thing. No doubt he was pushed out but not for being gay (in Calif. ?). And not for being old, the store near my house looks like on old folks home.

In summation. In 2008 he was put on notice that his performance was not up to snuff. In 2011 they found out he was gay and around then he was then written up for things he claims were lies.

He thought they used a diversity wheel to add value to his employment but apparently they dropped it. Ergo there's a company-wide conspiracy to fire gay males from the company.

I think there's a good chance that he was just an annoying employee and they got tired of him so they stopped cutting him slack and fired him. When a guy has to go with the wide conspiracy theory as reason for his firing, there's a good chance they are tough to deal with.

At first I was thinking maybe there are actuarially sound reasons to target gay employees, discrimination aside. It does seem possible that gay people (gay men in particular) use more health care. But wouldn't this be balanced out by the fact that they are less likely to have children who would require coverage?

The guy doesn't seem to have any proof, so that that makes it a bit of a difficult case for him. However it is Home Depot which does have a bit of history with class action discrimination lawsuits, so there's also that. The whime "Bernie's Boys" thing comes to mind where they pigeonholed female employees as cashiers, but restructured them from the BB team that dealt with contractor relations.

Question 1 on the company's insurance application is not "Provide ratio of homosexuals to regular people." There's no special extra secret gey tax in their insurance costs. The whole premise is laughable.

Hate to break it to the guy, but this is going on at many big retailers. Doesn't matter the sexual orientation.

Long-term management employees get paid a certain amount per zone they live in. After they've been there a while they max out with a pay cap for that area, but there's still that "one guy" making a big check for what you can bring a new person in to do for a much lower amount. There seems to be a formula, and the link is like a boilerplate list of "how to edge someone out". In our case it started with "you're one of the only salaried employees so we're gonna cut your payroll and let you figure out how to get this all done or you will be reprimanded". Add in a dose of emails from multiple departments of "this must be done TODAY" and morning, mid-day, mid-afternoon and evening conference calls and check ins. Then the beloved "PIP" that was also in the article. It's well known in retail. . . if you're put on a PIP, start updating your resume because you're getting ready to get shoved out the door.

Our family's swan song was "I'll be there tomorrow, and if you don't have x, y and z done by then, I'm going to give you two write-ups for the price of one, and be sure to cut payroll by 50% today because the company's sales are in the crapper this week". Pretty much "I'm coming to fire you tomorrow". After fifteen years working for that company, hubby called to say he was leaving his keys on the counter and walking out. His boss had the audacity to beg him to stay in his building until he could get there to write him up and fire him as he'd already done the same to another manager in the district that week and didn't want to be stretched too far.

YEARS of being what I call a "retail widow". Landed on our feet with a different company that while still has some of the same struggles, actually listens to its managerial employees. My only recourse is to flip off the old company's distribution center when we drive by it.
