I am surprised this was a test at all. I assume they are testing to see if the man develops an erection when viewing sexual imagery which would not prove that the man has or has not gained control of his desires. I could enter a room filled with highly attractive nude 18 year old bi-sexual women all playing with each other and not have an erection or have a huge erection. For me it would depend a lot more on how involved I am in the situation.

If you read the decision, that's pretty much what the justices had to say as well. The guy had a fixed sentence, meaning he could have got rock hard looking at newborns and it wouldn't have meant a damned thing.

/apparently the guy took pictures of his teenage daughter, at her request, for her modeling portfolio.

On the other hand, you're talking about a guy who thought taking nude photos of his underage daughter to distribute for "modeling" was a good idea....


I'm in no way condoning his actions, but when the trial judge and all of his parole officers classify him as very unlikely to reoffend, it seems a bit much to harass him for the rest of his life with requirements like, "let us measure your penis while you watch pornography."

The guy appears to be guilty of routine poor decision making ability, but he hardly fits any kind of predator profile. This is just another instance where the whole existence of the sex offender registry seems so stupid. It really doesn't seem right that one particular class of criminals are basically given a life sentence of parole, while everyone else who serves their time gets to melt into the wood work. Is hooking up with an underage girl or exposing yourself in the street really that much more traumatic than mugging and beating someone, or killing a family while driving drunk? Once the latter two get out and finish their parole, they're out for good.
